Cercs proposed appointing Sergi Valdé as interim comptroller secretary before the Generalitat

The Cercs City Council has closed the selection process to temporarily fill the position of secretary-intervention and has proposed to the General Directorate of Local Administration (DGAL) of the Generalitat de Catalunya the appointment of Sergi Valdé Guañabens. The decision is contained in the Mayoral Decree approving the final assessment and appointment proposal, published in the Official Gazette of the Province of Barcelona (BOPB) on November 4, 2026, with the reference CVE 202610163783. The text resolves file 2026/168 and exhausts the administrative route.

The position subject to the process is a third-class secretary position, secretary-intervention sub-scale, reserved for civil servant personnel with national qualification. The rules and the call for applications were approved by Mayoral Decree 2026/117, of May 6, 2026, which established an open competitive examination and provided for the creation of a job bank. On September 28, 2026, the qualifying tribunal approved the provisional list of persons who had passed all the tests of the process.

Only one applicant passes all tests

The decree certifies that the results have become final with a single passing person, Sergi Valdé Guañabens, with the following qualification:

• Opposition phase test: 29.00 points.
• Personal interview: 5.00 points.
• Merit assessment: 13.19 points.
• Total score: 47.19 points.
• File identification: DNI *0155 and entry registration number RE.1329.

The proposed applicant is the only person who obtained the highest score and who meets all the requirements demanded to occupy the position, according to the resolution signed by the mayor, Urbici Malagarriga i Suades, and by the acting secretary-interventor, Ramon Artigas i Costa, in Cercs on October 30, 2026.

Appointment proposal and waiver of the job bank

The decree deploys the decision in four points:

• Approve the final results of the selection process for the interim provision of the secretary-intervention position.
• Formulate the proposal to the DGAL to appoint Sergi Valdé Guañabens on an interim basis in the position reserved for civil servants with national qualification.
• Not constitute the job bank, given that none of the other applicants passed the convened selection process.
• Notify the resolution to the proposed person, within the timeframe of the rules to present the documentation accrediting the requirements, and publish the full decree on the municipal website, on the notice board of the electronic office, and in the BOPB.

The resolution also orders to report the agreement to the City Council Plenary in the next ordinary session to be held.

Legal framework and appeal routes

The decree bases its competence on article 21.1.g) of Law 7/1985, of April 2, regulating the bases of the local regime, which empowers the mayor’s office to approve calls for applications and appoint the corporation’s officials. It also invokes Royal Decree 128/2018, of March 16, on the legal regime of local administration officials with national qualification, and the recast text of the Law of the Basic Statute of the Public Employee, approved by Royal Legislative Decree 5/2015, of October 30.

Against this act, which exhausts the administrative route, the following may be filed:

• An optional appeal for reversal (recurso potestativo de reposición) before the mayor’s office within a maximum period of one month, in accordance with articles 123 and 124 of Law 39/2015.
• A contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance of Barcelona within a maximum period of two months, once the appeal for reversal has been resolved or presumably dismissed.

The publication leaves the Berguedà town hall with only one resolved interim appointment and without a waiting list for future absences or vacancies in a position critical to the ordinary functioning of the council: the secretary-intervention is the body that certifies agreements, controls legality, and audits municipal expenditure. Without an established pool (borsa), any substitution will have to go through a new call for applications or through the coverage decided by the DGAL.
