Cenes de la Vega updates the waste collection delegation to the Provincial Council

The Cenes de la Vega City Council has modified the agreement by which it delegates the provision of the public municipal waste collection and transport service to the Provincial Council of Granada, incorporating new clauses regarding the effective cost of the service and the specific tax. The decision was adopted by the municipal Plenary in an extraordinary session held on September 9, 2026, and is published in the Official Gazette of the Province of Granada number 179, dated September 16, 2026, with reference BOP-GRA-2026-179009.

The modification, signed by the mayor-president Ms. Montserrat Muñoz Sáez, updates the delegation agreement approved by the Plenary on January 29, 2026, to incorporate the sixth and seventh clauses of the model approved by the Governing Board of the Provincial Council of Granada. The stated objective is to guarantee the provision of a quality public service for citizens and the environment, improving management efficiency without jeopardizing the economy and financial sustainability of the Provincial Council.

Scope of the delegation

The delegation is granted with indefinite temporary validity and comprises the effective provision of the service once the necessary files are completed, particularly the procurement process, such that it will not be effective until that date. The agreement refers to Option B of the Regulatory Ordinance of the service, which includes:

• Separate collection of packaging, paper-cardboard, glass, textiles, oil, and batteries via containers on public roads, at no cost to the City Council.
• Packaging and paper-cardboard waste are excluded, as their collection is included in the municipal contract for the collection, containerization, and transport of urban solid waste and street cleaning (File 6623/2021), until December 7, 2032.

The Provincial Council will exercise the powers inherent to the public service, including regulatory and self-organization, programming and planning, expropriation, sanctioning, and the ex officio review of its acts.

Effective cost and specific tax

Pursuant to Article 26.2 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, when the Provincial Council assumes the provision, it will charge the City Council the effective cost of the service based on its use. The City Council will collect the tax, without prejudice to the possible delegation of collection to the Provincial Tax Service, and will pay the full amount of the settlements to the Provincial Council.

In accordance with Article 11.3 of Law 7/2022, of April 8, on waste and contaminated soils for a circular economy, the City Council is obliged to maintain in force a specific, differentiated, and non-deficit fee that allows for the implementation of pay-as-you-throw systems and includes the actual cost, direct or indirect, of collection and transport operations, maintenance and surveillance, and awareness campaigns.

Quarterly settlement and revocation

The effective cost shall be determined quarterly by the Provincial Waste Collection Service through an administrative file, based on direct and indirect costs. The calculation results from multiplying the tons of waste collected and transported by the cost per ton, with subsequent regularization and compensation of balances in the following quarters.

The City Council may only revoke the delegation if it justifies to the Provincial Council that it can provide the service at a lower effective cost, and must reimburse the expenses incurred, including the corresponding indemnities to the contractor and any damages caused. The agreement shall enter into force on the day following its publication in the Official Gazette of the Province of Granada.

Relevance for residents

The update of the agreement reinforces the economic and control framework of the waste collection service in Cenes de la Vega, linking municipal financing to the actual cost of the service and to a non-deficit specific fee. For residents, this means greater transparency in management and in the impact of costs, in line with state circular economy regulations, and consolidates the role of the Provincial Council of Granada as the service manager in the municipality.
