Celanova, summoned to the Contentious Court over a patrimonial claim
Por FactBox Admin

The Administrative Litigation Court No. 1 of Ourense has admitted an administrative appeal against the City Council of Celanova due to the presumed dismissal of a claim for patrimonial liability. The summons notice was published in section IV (Local Entities) of the Official Gazette of the Province of Ourense on October 9, 2026, and opens a period of nine days for potential interested parties to become parties to ordinary procedure 0000226/2026.
The appeal was filed at the request of Delmiro Miranda Álvarez and others, according to the notice signed by the mayor, Antonio Puga Rodríguez. The origin of the litigation is the claim for patrimonial liability (UE-4) that the plaintiffs formalized before the City Council of Celanova via a written submission presented on October 20, 2025. Having received no express response, the claim was understood to be dismissed by administrative silence, which opened the administrative litigation route.
The appearance period
The summons is addressed to all persons who may have the status of interested parties in the procedure. The period is nine days and is calculated from the day following the publication of the notice in the provincial gazette.
- Period: nine days.
- Start of calculation: the day following publication in the BOP.
- Body before which to appear: Administrative Litigation Court No. 1 of Ourense.
- Procedure: 0000226/2026, ordinary route.
The publication is made in compliance with the requirement issued by the court itself and under Article 49 of Law 29/1998, of July 13, regulating the administrative litigation jurisdiction, which mandates the summoning of potential interested parties when the defendant administration is the entity responsible for carrying out the notification.
Effects of appearing or not
Appearance is voluntary, but it has clear procedural consequences. Those who establish themselves as a party within the period will be able to defend their interests throughout the entire procedure.
- If appearing within the period: the person is established as a party.
- If appearing outside the period: they will be considered a party only for the non-precluded steps.
- If not appearing: the procedure will continue through its steps, without notifications on the court boards or by any other means.
The framework of the litigation
The patrimonial liability of the Administration is the mechanism by which compensation is claimed for damages caused by the functioning of public services. In these cases, the prior claim is presented to the administration itself and, if it does not resolve within the legal period, a presumed dismissal occurs, allowing the party to go to court.
The notice does not detail the amount claimed nor the nature of the damages, data which do not appear in the published text. What is recorded is the identification of the municipal file, UE-4, and the date of the claim letter, October 20, 2025.
The matter is being processed before the single-judge court of contentious-administrative proceedings based in Ourense, which is competent for disputes against the local entities of the province.
The publication of this summons is relevant for any person who may be affected by the ruling, as the nine-day period is peremptory: whoever does not appear in time will be bound by the outcome of the proceedings without receiving further notifications. The matter directly affects the City Council of Celanova, which must defend itself in the process and, if applicable, assume the compensation set by the court.
