Castilla-La Mancha expropriates land to expand the Dosbarrios cemetery

The Governing Council of Castilla-La Mancha has declared the urgent occupation of the lands affected by the expropriation necessary to execute the expansion of the municipal cemetery of Dosbarrios (Toledo) and the construction of 14 burial plots. The agreement, adopted on September 1, 2026, is published in the Official Gazette of Castilla-La Mancha (DOCM) number 172, dated September 8, 2026, under reference 2026/6439.
The declaration responds to the request submitted on July 8, 2026, by the Mayor-President of the Dosbarrios City Council to the Regional Ministry of Finance, Public Administrations, and Digital Transformation, which forwarded the file to the Governing Council. Previously, the municipal Plenary definitively approved the list of assets and rights affected by the works project on June 18, 2026.
The Urgency: Exhaustion of Capacity
The agreement bases the urgency on the immediate and unavoidable need for the land, given the exhaustion of the cemetery’s capacity and the certain risk of an insufficient number of burial plots in the short term, which would compromise the proper provision of an essential and mandatory public service. The Vice-Ministry of Local Administration and Administrative Coordination issued a favorable report regarding the declaration of urgency.
The Affected Lands
The expropriation affects two rustic land plots in polygon 26, in the El Bosque area, classified according to the P.O.M. of Dosbarrios as non-urbanizable rustic land of special protection as General Systems and Equipment. The total expropriated area amounts to 1,662.72 m², with a valuation of €2.00/m².
- Plot 1 (Polygon 26, Plot 33): owners Mr. Pedro Vega Espinosa and Ms. Ángela Guzmán Vega; affected area 586.24 m²; appraisal €1,172.48; cadastral reference 45059A026000330000ZP.
- Plot 2 (Polygon 26, Plot 35): owner Ms. María Rosario Martínez Raposo Prados; affected area 1,076.48 m²; appraisal €2,152.96; cadastral reference 45059A026000350000ZT.
Allegations and Appeals
During the public information period to which the request was submitted, allegations were presented, which were resolved by agreement of the Plenary on June 18, 2026, with the approval of the file and its submission to the Regional Ministry. The agreement exhausts the administrative route, in accordance with Article 38.2 of Law 3/1984, of April 25, on the Legal Regime of the Government and Administration of the Junta de Comunidades de Castilla-La Mancha.
An administrative appeal may be filed against it before the Administrative Chamber of the High Court of Justice of Castilla-La Mancha within two months from the day following its publication, or, optionally, a request for reversal (recurso de reposición) before the Governing Council within one month, in accordance with articles 123 and 124 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.
The measure guarantees the continuity of an essential service for the residents of Dosbarrios, who saw the availability of burial plots compromised in the short term. The affected owners retain the right to challenge the decision before the administrative courts, while the municipality ensures the expansion of its cemetery to meet the needs of the population.
