How the agreement can be appealed
According to point 4.4 of the Specifications, an administrative appeal (recurs d’alçada) may be filed before the mayor’s office against the agreement resolving the allegations and approving the final list of admitted and excluded applicants. The appeal must be based on any of the grounds for nullity or voidability provided for in articles 47 and 48 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. The lack of resolution of the appeal shall have the effect of dismissal, and the appeal shall not suspend the award procedure.
The publication closes the evaluation phase of the call and opens the period for challenging it, such that excluded persons who wish to dispute the decision must address the mayor’s office. For the four admitted persons, the final list is the previous step to the effective award of the social housing.
