Cantabria opens public consultation to correct the high-performance decree

The Government of Cantabria has opened the hearing and public information process for the modification of Decree 187/2023, of December 1, which establishes high performance in the field of sports in Cantabria. The decision was adopted by the General Secretariat of the Ministry of Culture, Tourism and Sport through a resolution signed in Santander on September 8, 2026, by the general secretary, Alejandra Perales Zamorano. The announcement is published in the Official Gazette of Cantabria number 179, corresponding to Thursday, September 17, 2026, with the official reference CVE-2026-7208.

The reason: internal discrepancies in the regulation

The resolution justifies the opening of the process on the grounds that “discrepancies have been noted between the operative part of the regulation and its explanatory content.” The text itself adds that such discrepancies “may affect the proper understanding and assessment of the text of the draft Decree,” which necessitates submitting it to public exhibition before its final approval.

The procedure is supported by Article 51 of Cantabria Law 5/2018, of November 22, on the Legal Regime of the Government, the Administration and the Institutional Public Sector of the autonomous community, in relation to Articles 129.5 and 133.1 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

The affected regulation governs the high-performance sports regime in Cantabria, an area that directly impacts athletes, clubs, and sports federations within the community.

Ten business days deadline

The hearing and public information period is ten (10) business days and begins to count from the day following the publication of the resolution in the Official Gazette of Cantabria, that is, starting from September 18, 2026.

• Duration of the process: ten business days.
• Start of the count: the day following publication, September 18, 2026.
• Recipients: any interested party, including athletes, clubs, and federations.
• Purpose: to submit in writing any allegations deemed appropriate regarding the content of the project.

Where to consult the text and submit allegations

The full text of the draft Decree can be consulted at the General Directorate of Sport, at calle Castilla 13, second floor, Santander, and on the Transparency Portal of the Government of Cantabria (www.transparencia.cantabria.es).

Allegations shall be addressed to the General Directorate of Sport and may be submitted through two channels:

• At the Registry of the Ministry of Culture, Tourism and Sport of the Government of Cantabria, at calle Lealtad 24, Santander.
• At any of the locations established in Article 134.8 of Cantabria Law 5/2018, of November 22.

Additionally, allegations may be submitted through the Transparency Portal website of the Government of Cantabria, in the box provided for this purpose and following the instructions contained therein.

The modification of Decree 187/2023 affects the recognition and conditions of high-performance sports in Cantabria; therefore, the final text will impact athletes aspiring to that qualification, the clubs they belong to, and the federations that manage the competitions. The hearing and public information process is the final opportunity for the Cantabrian sports sector to submit observations on the text. Those who do not present allegations within the period of ten business days will lose the means of formal participation in this regulatory drafting phase.
