Cangas de Onís expropriates a home in Covadonga to widen the road

The Cangas de Onís City Council has opened for public review the specific and individualized list of owners, assets, and rights affected by the compulsory expropriation necessary to execute the project for the demolition of a dwelling and the widening of the road on Avenida de Covadonga. The announcement is published in the Official Gazette of the Principality of Asturias (BOPA) number 177, dated September 14, 2026, under official reference 2026-07393.
The list was provisionally approved by Mayoral Decree No. 1780/2026, dated September 1, and stems from the project approved by Mayoral Decree No. 1419/2026, dated July 13. The action is being processed under file number PAT/2026/37.
An urban expropriation on road land
The affected property is classified as urban land and designated as urban infrastructure for road use by the consolidated text of the General Urban Development Plan of Cangas de Onís. Therefore, the action is considered an urban expropriation, and the declaration of public utility and the necessity of occupation operate in accordance with Article 104.1 of the consolidated text on territorial planning and urbanism of the Principality of Asturias (Legislative Decree 1/2004, of April 22) and Article 42 of the consolidated text of the Land and Urban Rehabilitation Law (Royal Legislative Decree 7/2015, of October 30).
The necessity of occupation is understood to be implicit in the approval of the project, in accordance with Article 17.2 of the Compulsory Expropriation Law of December 16, 1954, and Article 94 of the consolidated text of the Local Government Regime (Royal Legislative Decree 781/1986, of April 18).
The affected property and its owners
The list includes a single property, located at Avenida de Covadonga No. 58, with the following data:
- Registry identification: registry property No. 43,367 of the Property Registry of Cangas de Onís, CRU 33004000236795.
- Cadastral identification: cadastral reference 7921023UP2082S0001KU.
- Areas: 18.00 m² according to the Property Registry; graphic plot of 32 m² and 56 m² built according to the cadastre (ground floor dwelling of 32 m² and first floor of 24 m²); approximately 52.78 m² built according to the project.
- Owner 1: Mr. José Fernández Pérez, full ownership of an undivided share of 50%.
- Owner 2: Ms. María Mercedes Dombriz Gómez, full ownership of an undivided share of 50%.
- Title: sale and purchase, 3rd registration of April 18, 2005.
- Encumbrances: the property is free of encumbrances according to the registry certification of August 11, 2026, and there are no recorded leases or other compensable rights.
Period for objections and consultation of the file
In accordance with Articles 18 and 19 of the Compulsory Expropriation Law and 17 and 18 of its Regulations, the list is open for public inspection for a period of fifteen business days, counting from the day following the publication of the announcement in the BOPA. During this period, any person may submit written data to rectify possible errors or oppose, for reasons of substance or form, the necessity of the occupation.
The file shall remain available to interested parties at the municipal offices, located at Avenida de Covadonga no. 21, first floor, from 9:00 a.m. to 2:00 p.m., and on the City Council’s electronic headquarters. Allegations shall be addressed to the Mayor’s Office, indicating file PAT/2026/37, via the general electronic registry or by any of the means set forth in Article 16.4 of Law 39/2015, of October 1.
The published decree constitutes a procedural act that does not end the administrative route and against which no independent appeal may be filed, without prejudice to the allegations that may be formulated and the challenge of the agreement that will eventually resolve the necessity of occupation.
The expropriation affects a key tourist area of the council, at the access to Covadonga, and its outcome will condition both the compensation to the owners and the planned road improvement. Residents and rights holders now have the opportunity to review the published list and assert their interests before the occupation is definitively resolved.
