Caldes repeals the renewable energy tax and approves the service's rate 25
Por FactBox Admin

The Local Governing Board of the Caldes de Montbui City Council, acting by delegation of the Plenary in the ordinary session of October 27, 2026, has agreed to propose the repeal of the fiscal ordinance taxing renewable energy installations and to provisionally approve tariff 25 of the public prices for the local energy service, within file 7998/2026. The agreements are published in the Official Gazette of the Province of Barcelona on November 3, 2026, with the official reference CVE 202610161207, and are subject to a public exhibition period of 30 business days. The agreement is signed by the mayor, Isidre Pineda Moncusí, dated October 28, 2026.
The repeal of fiscal ordinance 29
The first point of the agreement proposes to the competent body the repeal of Fiscal Ordinance No. 29, which regulates the tax for the occupation of the municipal public domain derived from renewable energy installations. The motivation is explicit: the tax “does not adjust to the current configuration of the service,” according to the municipal technical report identified as doc. AUPAC 108073/2026, which also serves as the basis for the new tariff.
This is, therefore, a proposal for repeal and not a definitive suppression: it is up to the competent body to resolve it, and the agreement itself provides that the definitive agreements regarding public price tariffs, with the corresponding consolidated text, will be published in the Official Gazette of the Province and on the municipal website.
Tariff 25: 50 euros annually per kilowatt peak
The second point provisionally approves the new public price tariff for the local energy service in Modality A, with a single concept:
- Annual public price for registration in Modality A: 50 euros per year, amounts including VAT, fixed per kWp.
The tariff is grouped under the heading “Tariff 25. MUNICIPAL ENERGY SERVICE. MODALITY A”, which comprises the services provided by the City Council in relation to the municipal energy service in this modality. Since the amount is unitary per kWp, the final cost for users will depend on the power assigned to them.
Public consultation, publication and entry into force
The remaining agreements in the document establish the procedure and deadlines:
- Public exhibition on the municipal electronic notice board, with the full text of the new tariff, for 30 business days starting from the day after the publication of the announcement in the Official Provincial Gazette.
- Publication of the public exhibition announcement also in a newspaper of maximum circulation in the province.
- Publication of the final agreements and the consolidated text in the Official Gazette and on the municipal website.
- Entry into force of the new tariff the day after the publication of the final agreements, remaining in effect until a new modification is agreed upon.
- Entry into force of the public price as of January 1, 2027, provided that final approval has occurred and the publication requirements have been met.
- Notification of the agreement to the economic services area and the affected municipal services.
During the exhibition period, persons with a direct interest or who consider themselves affected may examine the file and submit claims under Article 18 of the consolidated text of the Law regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5. If none are submitted, the agreements will be definitively approved.
The background: 1,264 kWp installed and 608 beneficiaries
The decision comes amidst the full deployment of the Local Energy Community of Caldes, the CEL. According to mayoral decree 1768/2026, of September 3, 2026 (file 7091/2026), the City Council has installed photovoltaic panels on municipal facilities and plots for a total of 1,264.19 kWp, and there are currently 608 beneficiaries in modality A.
That same decree opened a call for a maximum of 100 additional beneficiaries in the urban center, with an application period from October 14 to 30, 2026, based on the rules definitively approved on February 5, 2025 (file 7165/2024).
It should be noted that the published agreement is a non-qualified procedural act: no appeal can be filed against it, according to Article 112.1 of Law 39/2015, of October 1, without prejudice to alleging opposition in the resolution that closes the procedure. Once the period for allegations has elapsed, the new tariff will be consolidated; if there are no changes, the price of 50 euros per kWp per year will be what users of the municipal energy service will pay starting January 1, 2027.
For the residents of Caldes who are part of the CEL or who wish to join, the news has two interpretations: the tax for occupation of the public domain linked to renewable installations disappears and, at the same time, a specific public price for registration in the service is established for the first time. This affects both the annual bill of those already enrolled and the profitability calculation for those who wish to join, as well as the municipal margin to finance the maintenance of the installations.
