Cañada Rosal puts out to tender the kiosk of the Chato de los Garbanzos Forest Park

The City Council of Cañada Rosal (Seville) has opened an open competitive bidding procedure to award the administrative concession for the private use of public domain for the kiosk in the Chato de los Garbanzos Forest Park. Mayoral Resolution No. 288/2026, dated October 5, 2026, approves the file, the Administrative Specifications, and the Technical Specifications, and the announcement is published in the Official Gazette of the Province of Seville No. 196, dated October 8, 2026, with reference BOP-SE-2026-196007. Any natural or legal person who meets the requirements established in the regulatory specifications may submit an offer.

The process is promoted by the mayor-president, Rodrigo Rodríguez Hans, the signatory of the announcement. This is an administrative concession for the private use of public domain assets, of a patrimonial nature and excluded from the scope of Law 9/2017, of November 8, on Public Sector Contracts pursuant to article 9.1. Its preparation and award are governed by the specifications and, for matters not provided for, by Law 7/1999, of September 29, on Assets of Local Entities of Andalusia, in accordance with articles 3, 4, and 58 to 75 of Decree 18/2006, of January 24, and Royal Decree 1372/1986, of June 13.

A bar, cafeteria, and catering kiosk

The authorized activity includes those typical of a kiosk, bar, cafeteria, and catering: kitchen, griddle, fryer, preparation and sale of food, alcoholic beverages, packaged products, ice cream, sweets, takeout food, and a terrace. The sale of tobacco will require the corresponding administrative authorization. Music, including speakers, background music, or any reproduction system, is expressly prohibited both inside and outside the establishment.

The areas of the asset, according to the survey plan incorporated into the file, are:

• Kiosk: 21.40 m².
• Warehouse: 9.60 m².
• Toilets: 16.40 m².
• Paved area: 39.95 m².
• Terrace: 322.63 m².

The property is located at Chato de los Garbanzos Street, 41439 Cañada Rosal, and will be delivered in its current state by means of a formal record. The City Council provides a sink, a refrigerated counter front, and an extractor hood; the rest of the furniture, utensils, and machinery are the responsibility of the successful bidder.

Fee, term, and award criteria

The fee serving as the basis for the tender is 100 euros per month, VAT included, and offers shall be formulated upwards from that amount, with lower proposals not being accepted. The fee does not include water or electricity consumption, which shall be paid in full by the concessionaire, and it shall be paid monthly within the first five days of each month.

The award will be resolved based on a single criterion: the highest fee offered, valued out of 100 points using the formula POi = 100 × Oi / MO. The bidding process will be documentary and secret, submitted in a sealed envelope, without oral auctions or improvements after the deadline. In the event of an exact tie, it will be resolved by a public draw among the tied offers.

The initial term for the use of the asset is three years, extendable for one additional year up to a maximum duration of four, provided that the competent body expressly agrees to it and upon request by the concessionaire three months in advance. The deadline for submitting offers is twenty calendar days starting from the day following the publication of the announcement in the Official Gazette of the Province of Seville.

Requirements, committee, and sanctioning regime

Natural or legal persons, Spanish or foreign, with full legal capacity, proven solvency, and no prohibitions from contracting or holding public domain concessions may apply. Each candidate may submit only one offer, in two sealed and signed envelopes: Envelope A containing the administrative documentation and Envelope B containing the economic offer. No definitive guarantee is required.

The contracting committee is chaired by Laura García Duvisón, second deputy mayor, with Francisco Rodríguez del Campo as the substitute chair. The members are Manuel Martín Trujillo, secretary-auditor; José Antonio Calderón León, municipal technical architect; and Ana Ojeda Rodríguez, administrative assistant; Ana María Beltrán Montes acts as secretary.

The specifications define minor, serious, and very serious offenses. Minor offenses will be penalized with a fine of up to 300 euros and serious offenses with up to 600 euros; very serious offenses may be punished, for the first time, with a reduction of up to one-quarter of the term of validity or with a declaration of expiration. Recurrence of a very serious offense may lead to the termination of the concession without the right to compensation.

The call for tenders reactivates the hospitality operation of a municipal facility in the heart of the forest park and opens a business opportunity for hoteliers and entrepreneurs in the region, while guaranteeing the City Council of Cañada Rosal a minimum income for the private use of the public domain and the conservation and cleaning of the kiosk, the terrace, the restrooms, and their immediate surroundings.
