Cádiz publishes two notices of sanctioning proceedings in several matters

The Territorial Delegation of Agriculture, Fisheries, Water and Rural Development in Cádiz has published two announcements, both dated October 23, 2026, regarding administrative sanctioning proceedings initiated in various matters. The notices appear in section 5.2 of “Other official announcements” of the Official Gazette of the Regional Government of Andalusia (BOJA) no. 210, corresponding to Thursday, October 29, 2026, with references text no. 14176 and text no. 14177, each consisting of two pages.

The issuing body depends on the Ministry of Agriculture, Fisheries, Water and Rural Development of the Regional Government of Andalusia, whose provincial delegation in Cádiz assumes the instruction and resolution of administrative sanctioning files in matters within its competence. Under the heading “various matters,” the procedures referring to water, fisheries, animal health and welfare, and rural development are grouped, according to the practice followed by this delegation throughout the year.

The publication of this type of announcement is not an isolated event. In recent months, the same delegation in Cádiz has recurrently used the BOJA to process its files:

• August 7, 2026: announcements on procedures in various matters, water, and fisheries (text no. 10987, 10989, 10990, and 11030), published on August 13.
• August 12, 2026: procedures regarding fisheries, animal health, domestic animals, and various matters (text no. 11097, 11098, 11099, 11101, 11103, 11119, and 11120), disseminated on August 19.
• September 24, 2026: files regarding fisheries and various matters (text no. 12646, 12647, and 12648), published on September 30.
• October 5, 2026: procedures regarding fisheries and domestic animals (text no. 13205 and 13206), appearing on October 9.
• October 14 and 20, 2026: files regarding water and domestic animals (text no. 13701, 13872, and 13951).

Two twin announcements in the same issue

The BOJA of October 29 incorporates two publication resolutions with identical dates and headings: text no. 14176 and text no. 14177. Both occupy two pages and share the formula “relative to administrative sanctioning proceedings initiated in various matters,” which indicates that this is not a duplication of the same notice, but rather two distinct blocks of files processed separately and published simultaneously.

The length of two pages in each case is greater than that of announcements dedicated to a single matter, which are usually resolved on a single page. This larger volume is consistent with the accumulation of several files in a single announcement and the need to identify each interested party and the administrative act being notified to them.

Notification when personal attempt fails

These announcements serve to convey instructional acts and the resolution of files to interested parties when individual notification could not be carried out. The BOJA thus becomes the formal channel for the procedure to continue, meaning that those affected must stay alert to the publication and appear before the provincial delegation. Other bodies employ the same formula in the same issue of the bulletin, such as the summons for appearance announcements from the Territorial Delegation of Agriculture, Fisheries, Water and Rural Development in Córdoba, which explicitly state that the notification was attempted «without effect for reasons not attributable to this Administration».

In parallel, the same issue includes the Resolution of October 19, 2026, from the Seville delegation, which approves the Annual Inspection, Surveillance and Control Program for Water Use within the scope of the Guadalete and Barbate Hydrographic Demarcation in the province of Seville for 2026 (text no. 14214), a surveillance framework that shares a basin with a large part of the province of Cádiz.

What it means for those affected

Publication in the BOJA activates the procedural deadlines: anyone listed as an interested party in the files of announcements text no. 14176 and text no. 14177 has, from the appearance of the bulletin, the public reference to become aware of the act addressed to them, submit allegations, and consult the status of their file before the Territorial Delegation of Agriculture, Fisheries, Water and Rural Development in Cádiz. Those who do not appear remain subject to the processing that the Administration decides in accordance with the file.

The relevance of these announcements is twofold. For those affected, because the effective exercise of their right to defense depends on them in procedures that may culminate in sanctions in matters such as water, fishing, or livestock. For the general public, because the continuous stream of publications from the Cádiz delegation allows for monitoring the pulse of the inspection and sanctioning activity of the Junta de Andalucía in a province with a strong agricultural, fishing, and irrigation presence.
