Por FactBox Admin

Cáceres: la Diputación amplía un año el plazo del Plan de Pedanías

The Provincial Council of Cáceres has extended the execution period for works and the justification of expenditure for the 2024 Special Plan for Pedanías (sub-municipal districts), endowed with 540,000 euros, by one year due to the rise in material prices and the shortage of labor. The decision was signed by the third vice-president and delegated deputy of the Area of Development, Mobility, and Provincial Agenda and published in the Official Gazette of the Province of Cáceres (BOP) no. 0212, dated November 5, 2026, with reference CVE: BOP-2026-5156.

The 2024 Special Plan for Pedanías was approved by the Plenary of the provincial corporation in an extraordinary session on November 23, 2023, with an initial total amount of 540,000 euros. In an ordinary session on February 29, 2024, the Plenary approved the development of the investments and their designation in the terms requested by the affected town halls.

The regulatory instructions for execution and justification were approved by presidential resolution on April 11, 2024, published in the BOP no. 0073 on April 16, 2024. A subsequent presidential resolution, dated October 23, 2025, had already modified the deadlines, setting the end of execution for October 30, 2026, and the justification limit for January 29, 2027.

One more year to execute and justify

The first section of the resolution modifies point VI of the development instructions, adding one year to the dates agreed upon in the resolutions of April 11, 2024, and October 23, 2025. The new deadlines are:

  • Execution of expenditure completed before October 29, 2027, the maximum date to sign the reception act or, where applicable, the act of recognition and verification.
  • Justification of compliance with the grant before January 31, 2028, the limit for submitting the original supporting documentation via the electronic office, without prejudice to any correction period that may be granted.

The remaining paragraphs of section VI of the instructions remain unchanged and in force.

Materials, labor, and fuels

The announcement justifies the extension on the grounds that the province’s town halls are facing “serious difficulties” in meeting the deadlines due to the rise in material prices and the shortage of labor in construction trades, circumstances that are not attributable to the local corporations. Added to this is the armed conflict in Iran, which has caused a “considerable increase” in fuel prices and significant damage to economic activity and public and private initiatives, which was unforeseeable for any diligent administration.

The resolution, issued following a proposal from the Head of the General Planning Service, maintains that there is no provision to the contrary that prevents the modification of deadlines due to force majeure reasons beyond the control of both the Provincial Council and the affected city councils.

Publication, notification, and appeal process

The second section orders the publication of the resolution in the Official Provincial Gazette and the notification thereof to the beneficiary city councils and the areas of the Provincial Council that may be affected. The document, dated in Cáceres on October 29, 2026, and signed by the secretary Álvaro Casas Avilés, is found on pages 24883 to 24885 of the gazette.

Pursuant to Article 88.3 of Law 39/2015, of October 1, the resolution is final in administrative proceedings. A contentious-administrative appeal may be filed against it within two months before the Courts of Cáceres or, optionally, a motion for reconsideration before the Plenary within one month of its publication. In disputes between public administrations, Article 44 of Law 29/1998, of July 13, requires a prior request within two months from notification or publication.

Framed within the 2030 Agenda

The plan is part of the Local Action Plan of the Province of Cáceres, “The Province You Want”, approved by the Plenary on September 6, 2022, to fight against depopulation. The resolution links the investments to several Sustainable Development Goals of the 2030 Agenda:

  • SDG 3: Good health and well-being.
  • SDG 6: Clean water and sanitation.
  • SDG 9: Industry, innovation and infrastructure.
  • SDG 11: Sustainable cities and communities.
  • SDG 13: Climate action.

The extension prevents the beneficiary city councils from losing the contributions already committed and grants them one full additional fiscal year to tender, execute, and justify works that, under the previous deadlines, were destined for non-compliance due to reasons beyond their management.
