Por FactBox Admin

Cáceres emplaza a interesados en el contencioso por abuso de temporalidad

The Administrative Litigation Court No. 2 of Cáceres has requested the Provincial Council of Cáceres to summon any potentially interested parties in the summary proceeding 153/2026, filed by the interim civil servant Liliana Angelina de Jesús Barrios Lara against the denial of her claim for compensation due to abuse of temporary employment. The announcement is published in the Official Gazette of the Province of Cáceres No. 0194, dated October 9, 2026, Section I - Local Administration, page 23068, with official reference BOP-2026-4741. Interested parties have a period of nine days to appear before the court.

The text is signed by the Chief Clerk of the provincial corporation, Álvaro Casas Avilés, in Cáceres on October 7, 2026, and is issued in compliance with the judicial request made in summary proceeding 153/2026. The publication is based on Article 49 of the Law Regulating Administrative Litigation Jurisdiction, which requires the summoning of all those who may have a legitimate interest in the process.

The origin of the litigation is a claim for compensation derived from the abuse of temporary employment suffered during the appellant’s service relationship as an interim civil servant of the Provincial Council of Cáceres. The administrative route was exhausted with two successive resolutions from the corporation, both of which were dismissive, before the matter reached the courts.

A chain of denial resolutions

The previous administrative file is structured into two acts issued by the Presidency of the Provincial Corporation:

  • Resolution No. 2026-04/61935, dated April 16, 2026, which denied the claim for compensation filed by the appellant for the abuse of temporary employment suffered.
  • Resolution No. 2026-05/63095, dated May 27, 2026, which dismissed the optional appeal for reversal filed against the former.

Having exhausted that route, the interested party has turned to the administrative litigation jurisdiction, where the matter is being processed as summary proceeding 153/2026 before the Administrative Litigation Court No. 2 of Cáceres.

Nine-day period and effects of appearance

The announcement sets the conditions for third parties with an interest to intervene in the proceeding:

  • A period of nine days counting from the day following the publication of the announcement in the provincial gazette.
  • Appearance before the Administrative Litigation Court No. 2 of Cáceres in relation to summary proceeding 153/26.
  • Anyone who appears after the indicated deadline will be considered a party only for the proceedings that have not yet expired.
  • If no one appears in a timely manner, the proceeding will continue through its steps without the need for notifications in court or by any other means.

Other recent summons from the Provincial Council

This is not the first summons of this type published by the provincial institution in recent weeks. The Official Gazette of the Province of Cáceres No. 0183, dated September 24, 2026, page 21864, reference BOP-2026-4420, recorded the summons for abbreviated procedure 177/2026 before the Administrative Litigation Court No. 1 of Cáceres, at the request of María Ángeles García Amador and relating to a selection process for two Technical Architect positions. In both cases, the procedure is identical: the corporation acts as the party requested by the court and forwards the announcement to potential interested parties.

The relevance of this publication is twofold. For the interim staff of the Provincial Council of Cáceres, it opens the door to appearing in a procedure that may establish criteria regarding compensation for the abuse of temporary employment in the provincial administration. For the corporation itself, the announcement marks the beginning of the judicial phase of a conflict that has already consumed two administrative resolutions and will be resolved, if applicable, before the Administrative Litigation Court No. 2 of Cáceres.
