Burguillos del Cerro approves its citizen coexistence ordinance

The City Council of Burguillos del Cerro (Badajoz) has made the modification of its Municipal Ordinance Regulating Citizen Coexistence final, as no claims were submitted during the public exhibition period. The initial plenary agreement, dated July 17, 2026, is thus automatically approved, and its full text is published in the Official Gazette of the Province of Badajoz number 173, dated September 10, 2026, via Announcement 3543/2026.

The regulation is issued in compliance with Article 70.2 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, and shall be applicable throughout the municipal district, binding all its inhabitants. Its objective is to achieve collective well-being and organize coexistence in peace and with equality of rights and obligations, modulating the activity of residents in respect and freedom.

The “noise-free hour” for people with ASD

One of the most notable innovations is the incorporation of the “noise-free hour”, an inclusion initiative during religious, cultural, or traditional festivities which consists of turning off the music and silencing the speakers of the attractions so that people with ASD (autism spectrum disorder) and high sensory sensitivity can enjoy them without overstimulation.

• The day and time will be agreed upon with the owners of the attractions.
• If an agreement is not reached, the City Council will establish the time slots.
• The measure seeks to reduce the level of auditory stimuli so that children and young people can enjoy the attractions in a calmer, safer, and more adapted manner.

Noise, pyrotechnics, and schedules

The ordinance tightens the regulation of activity on public roads and within establishments. Between 0 and 7 hours, it is prohibited to shout on public roads, keep engines running for more than five minutes, or honk the horn, as well as any commercial or industrial activity that causes nuisance to the neighborhood.

• Firing firecrackers, rockets, and pyrotechnic items on public roads is prohibited unless express authorization is granted for local, religious, cultural, or traditional festivals, limiting the time and place.
• Motorcycles and mopeds must circulate with an approved exhaust pipe; the Local Police will provide 48 hours to normalize the vehicle before its removal.
• Public establishments may not have doors, windows, or openings to the outside with music audible from the exterior, and failure to comply with closing times is classified as a serious offense.
• Shows and recreational activities must communicate their poster or program to the City Council at least three days before making it known to the public.

Sanctioning regime

Infractions will be processed in accordance with Law 39/2015, of October 1, on the Common Administrative Procedure, and will be penalized with fines according to their severity:

• Minor offenses: 30.00 euros.
• Serious offenses: 90.00 euros.
• Very serious offenses: 150.00 euros, which may be increased up to the maximum legal limit depending on the damages, danger, recurrence, and severity.

The ordinance shall enter into force upon its full publication in the Official Gazette of the Province of Badajoz and shall remain in effect until its modification or repeal is agreed upon. An administrative appeal may be filed against the agreement before the Administrative Litigation Chamber of the High Court of Justice of Extremadura within two months of publication, in accordance with Article 46 of Law 29/1998, of July 13. The final approval makes Burguillos del Cerro a local benchmark in sensory accessibility, while providing the municipality with a clear framework for daily coexistence, hospitality activities, and the celebration of festivities, with direct consequences for all residents and local establishments.
