Bocapán Resort gains access to early VAT recovery in Tumbes

The Ministry of Foreign Trade and Tourism (MINCETUR) approved BOCAPAN RESORTS S.A.C. as a qualified company to access the Special Regime for the Early Recovery of the General Sales Tax (IGV) for the development of the “Bocapán Resort” project. The decision is contained in Ministerial Resolution No. 324-2026-MINCETUR, from Lima, September 4, 2026, published in the Legal Norms section of the Official Gazette El Peruano on Thursday, September 10, 2026 (Year XLIII, No. 19511).

The regime, regulated by Legislative Decree No. 973 and its Regulations approved by Supreme Decree No. 084-2007-EF, allows for the refund of the IGV levied on the import or local acquisition of capital goods, intermediate goods, services, and construction contracts carried out during the pre-productive stage of the project.

Investment commitment and term

The amount of the investment commitment undertaken by BOCAPAN RESORTS S.A.C. amounts to US$ 18,822,000.00 (Eighteen Million Eight Hundred Twenty-Two Thousand and 00/100 United States Dollars), excluding IGV. The execution period is two years, five months, and five days, counted from November 25, 2024, the project start date, until April 30, 2027.

End of execution period: April 30, 2027.
Period for samples, tests, and trials: from March 1, 2027, to April 30, 2027.

Project characteristics

The “Bocapán Resort” project comprises the construction of a 4-Star Hotel located in the Bocapán Population Center, Panamericana Norte Highway No. 1232, district of Zorritos, province of Contralmirante Villar, department of Tumbes. The application for admission was submitted on November 21, 2024, to the Agency for the Promotion of Private Investment (PROINVERSIÓN), which declared it admissible and issued a favorable technical and legal opinion.

The resolution also approves the list of services and the list of construction contracts that are part of the regime’s coverage, as Annexes II and III of the regulation. Authorized services include:

Legal, accounting, and tax advisory.
Consultancy in hotel direction and management.
Technical supervision of civil works and project management.
Architecture and engineering services.
Market studies and interior design.

Regarding construction contracts, the EPC Construction Contract for a building intended for hotel use and the contract for the installation of furniture, completion, and finishes of the entire building are authorized.

Relevance for tourism

The rating of BOCAPAN RESORTS S.A.C. constitutes a relevant incentive for private investment in the tourism sector of the Tumbes region, by allowing the early recovery of IGV (VAT) during the pre-productive stage of a large-scale hotel project. The resolution was signed by the Minister of Foreign Trade and Tourism, Rogers Valencia Espinoza, and mandates its publication on the MINCETUR institutional portal on the same day as its dissemination in the official newspaper.
