Bergondo aproba definitivamente a expropiación de 40 fincas para seis obras municipais

The Plenary of the Bergondo City Council has definitively approved the projects for six municipal works and the lists of assets and rights requiring occupation to proceed with their execution, an agreement that includes the declaration of public utility and the compulsory expropriation of the affected properties. The decision was adopted in the ordinary session of September 24, 2026, and is published in the Official Gazette of the Province of A Coruña no. 191, of October 6, 2026, under announcement number 2026/6386 and file 2026/X998/000003.

Framework of the agreement and background

The file stems from the 2026 Municipal Action Plan, definitively approved by the Plenary in the ordinary session of May 28, 2026. In the session of September 24, the projects were approved, the public utility of their execution was declared, and compulsory expropriation was agreed upon, in accordance with article 94 of Royal Legislative Decree 781/1986, of April 18.

The file was presented to the public via an announcement in the Official Gazette of the Province no. 105, of June 5, 2026, and on the same date in the newspaper La Opinión Coruña and on the electronic notice board of the municipal electronic headquarters. Individual notification was carried out to the interested parties and, when this was not possible, the edictal notification was published in the Official State Gazette no. 196, of August 11, 2026.

Resolved objections and technical report

The Plenary fully accepted the grounds of the technical report issued by the agricultural technical engineer Beatriz Blanco Lois, member no. 1.909 and author of the expropriation annexes, dated September 22, 2026, with entry registration number 202699900004569. On that basis, it resolved the seven objections submitted during the public exhibition period:

  • Dismissed: nos. 1 and 5, regarding the Paso do Rego do Cabanés project in Fiobre, and nos. 2 and 4, regarding the Gandarío-Cangas-Casal de Ouces road.
  • Partially accepted: no. 3, regarding the Gandarío-Cangas-Casal de Ouces road.
  • Accepted: no. 6, regarding the Gandarío-Cangas-Casal de Ouces road, and no. 7, regarding the Paso do Rego do Cabanés in Fiobre.

Deadlines and means of appeal

Against this agreement, and before the same body that issued it, an appeal for reversal may be filed within one month from the day following its publication, with suspensive effects until the express resolution is notified. Directly or against the resolution of the appeal for reversal, a contentious-administrative appeal may be filed within two months, in accordance with articles 8, 9 and 10 of Law 29/1998, of July 13. The announcement was signed in Bergondo on September 30, 2026, by the mayor Alejandra Pérez Máquez.

Definitive approval has been granted via municipal administrative channels and the phase of effective occupation of the lands is open, so the owners of the 40 listed properties must be attentive to individual notifications and appeal deadlines if they wish to dispute the affected area or the conditions of the expropriation.
