Benitatxell suspends the terrace tax for local hospitality businesses

The City Council of El Poble Nou de Benitatxell has definitively approved the suspension of the tax for the occupation of public land with tables, chairs, kiosks, or any other form for profit purposes during the years 2026, 2027, and 2028. The decision, adopted by the Plenary in an ordinary session held on June 26, 2026, has been published in the Official Gazette of the Province of Alicante number 158, dated August 21, 2026, after becoming definitive as no claims were filed during the public exhibition period.

The measure means that during this three-year period, the tax regulated in the municipal ordinance will not accrue, providing direct fiscal relief for the municipality’s hospitality establishments that occupy public roads with their terraces.

A plenary agreement elevated to definitive

The modification of the Municipal Ordinance Regulating the Tax for the occupation of public land with tables, chairs, kiosks, or any other form for profit purposes was initially approved by the Plenary on June 26, 2026. Since no claims were filed during the public exhibition period, the agreement was automatically elevated to definitive.

The full text is made public in compliance with the provisions of article 17.4 of the Recast Text of the Law Regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5.

Scope and validity of the suspension

The final provision of the ordinance establishes the exact terms of the suspension:

• The tax is suspended during the years 2026, 2027, and 2028.
• During said period, the tax regulated in the ordinance will not accrue.
• Once the period has ended, the ordinance will fully regain its validity on January 1, 2029, without the need for an express agreement.

The announcement is signed by the Acting Mayor, Ms. María Teresa Roldán Pastor, in El Poble Nou de Benitatxell.

A breather for local hospitality

The suspension of the terrace tax is part of a policy to support the hospitality sector, one of the economic engines of this coastal town in the Marina Alta. By eliminating the levy for the occupation of public roads for three fiscal years, the council seeks to alleviate the tax burden on bars, restaurants, and kiosks that set up their terraces in the municipality’s streets and squares.

The measure, which is temporary and automatically reversible, allows businesses to plan their medium-term costs without the cost of the tax, pending the ordinance regaining full validity starting in 2029.
