Benavides abre el proceso para elegir juez de paz titular y sustituto

The Benavides City Council (Benavides de Órbigo) has opened the public call to select the two individuals who will hold the positions of Chief Justice of the Peace and Substitute Justice of the Peace in the municipality. The call is approved by Mayoral resolution and published in the Official Gazette of the Province of León number 204, corresponding to Tuesday, October 27, 2026, with official reference BOP-LE-2026-204001. The deadline for submitting applications is ten days.

The call is issued under Regulation 3/1995, of June 7, on Justices of the Peace, a regulation that the resolution itself invokes in each of its sections. This regulation develops the regime of the peace courts provided for in the Organic Law of the Judiciary, which grants city councils the initiative in choosing the people who will occupy these positions in municipalities where there is no court of first instance.

The announcement appears in the summary of the gazette under the heading of Local Administration, in the City Councils section, and shares the edition with other agreements from the same council, such as the final approval of a credit modification file. The resolution is electronically signed by the mayor, M.ª Esperanza Marcos Álvarez, in Benavides de Órbigo on October 24, 2026, three days before its official publication.

Requirements for applicants

The call details the conditions that those opting for either of the two positions must prove:

  • Possess Spanish nationality, in accordance with Article 1 of Regulation 3/1995.
  • Be of legal age.
  • Not be subject to any of the causes of incapacity established in Article 303 of the Organic Law of the Judiciary.
  • Not be affected by the incompatibilities and prohibitions regulated in Articles 389 to 397 of the Organic Law of the Judiciary and in Article 14 of Regulation 3/1995.

Where and how to submit applications

The application form is provided at the offices of the Benavides City Council and is also available on the municipal electronic office at the address aytobenavides.sedelectronica.es. Applications shall be submitted at the council’s entry registry or through any of the channels provided for in Article 16.4 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

The calculation of the deadline begins the day after the publication of the resolution in the provincial gazette, so the ten days are counted from October 28, 2026. For any inquiries, the council provides its address at Avenida Órbigo, 37, Benavides de Órbigo (24280, León), as well as the telephones and fax of the town hall.

A procedure with direct effects on the judicial life of the municipality

Justice of the peace courts are the first judicial instance for many residents of Leonese municipalities without a court of first instance: they assume competencies in civil matters, civil registry, and cooperation with higher courts. Hence, the selection of their holders is not a minor formality, but a decision that affects the daily judicial care of the locality.

With this call, the Benavides City Council simultaneously fills the titular and substitute positions, which ensures the continuity of the service even in the event of absence, vacancy, or illness of the presiding judge. Interested parties have just over a week to formalize their candidacy before the municipal registry; once this period has elapsed, the corporation will continue the designation procedure in accordance with the regulations governing these appointments.
