Barberà approves the renovation of the sewage system on Pla dels Avellaners street

The City Council of Barberà del Vallès has definitively approved the executive works project to renovate the separate sewerage network located on Pla dels Avellaners street, with a total contract execution budget of 1,043,324.39 euros, VAT included. The decision was adopted by the Mayor’s Office through Decree no. 2026-3360, dated September 24, 2026, and was made public in the Official Gazette of the Province of Barcelona (BOPB) on October 19, 2026, with the official reference CVE 202610151940 (pp. 1-5). The project is processed as a complete work and resolves file 319/2026.

The decree, signed by Mayor Francisco Javier Garcés Trillo, closes the procedure established by article 37 of the Regulation of works, activities and services of local entities of Catalonia (ROAS), approved by Decree 179/1995: initial approval, public information and individualized notification, and definitive approval. The publication also responds to the mandate of article 38.2 of the same regulation. The processing is framed within the Municipal Action Plan 2023-2027, approved by the Plenary on July 24, 2024, within the scope “Healthy, green and friendly Barberà”, strategic axis 2 and specific objective 3.

A project drafted by the municipal company SABEMSA

The project was drafted by Serveis i Aigües de Barberà del Vallès Empresa Municipal, SA (SABEMSA), according to the assignment made by the City Council. The contractual precedent is the award, on September 25, 2024, of the service contract for the drafting of the project and the technical management of the works, processed with decree 2024LLDC002873 within file N522240004.

The technical procedures prior to the definitive approval were as follows:

• Delivery of the executive project on June 3, 2026, with entry registry E2026015846.
• Supervision minutes signed on June 18, 2026, corresponding to session 4/2026, with a favorable report from the multidisciplinary team of the Territory and Environment Area.
• Technical report dated June 23, 2026, from the Public Space and Sustainability Section, which qualifies the action as a complete work in accordance with article 13.3 of Law 9/2017, on public sector contracts.
• Order from the delegated council for Territorial Cohesion, Environment and Energy Transition, dated July 8, 2026, which initiates the file.
• Resolution proposal PR/2026/1584, dated September 23, 2026.

Public information without objections

The initial approval was formalized by Decree no. 2026-2516, dated July 9, 2026, with the same budget. Edict 316/26 was published in the BOPB on August 3, 2026, and was displayed on the municipal electronic notice board between August 3 and September 14, 2026, both inclusive.

According to the Secretariat’s diligence of September 21, 2026, incorporated into the file, no allegations or claims were filed at the general Registry of the Citizen Service Office during the public information process. The project is thus approved without modifications with respect to the version submitted for exhibition.

Budgetary fit and municipal competence

The budget is broken down into 862,251.56 euros base and 181,072.83 euros VAT. The competence to approve works projects corresponds to the Mayor’s Office under article 21.1.o of Law 7/1985, regulating the bases of the local regime, and under the second additional provision of Law 9/2017, which sets the threshold at 10 percent of ordinary resources and at 6 million euros. The Mayor’s Office had expressly reserved this competence by decree 2024LLDC000182, of January 29, 2024.

The general budget for 2026 was initially approved by the Plenary on November 19, 2025, with total expenses of 64,282,437.74 euros, and became final with the announcement published in the BOPB on December 18, 2025.

Publication and means of appeal

The resolution orders the publication of the agreement in the BOPB and in the Official Gazette of the Generalitat de Catalunya, with insertion on the municipal notice board, and notification to the drafting team. Against the act, which is final and ends the administrative route, a motion for reconsideration may be filed before the same body within a term of one month, or a contentious-administrative appeal within a term of two months.

The renovation of the separate sewer network of Pla dels Avellaners street is one of the public space actions planned in the current municipal plan and opens the door to the tendering of the work, with an amount that places it among the relevant municipal investments of the fiscal year and which is of particular interest to construction companies in the sector.
