Barbastro somete a información pública su nueva Ordenanza de Convivencia Ciudadana

The Plenary of the Barbastro City Council initially approved, in an ordinary session on September 29, 2026, the modification of the municipality’s Citizen Coexistence Ordinance. The agreement is published in the Official Gazette of the Province of Huesca number 189, dated October 2, 2026, with the official reference BOPH-2026-189009, and opens a thirty-day period for public information and hearings for interested parties. If no claims are filed within that period, the modification will be definitively approved.

The announcement is signed by the Mayor-President, Fernando Torres Chavarría, in Barbastro on September 30, 2026, and is processed under file 1858781Q (NIF P2206100F). The full text of the ordinance is included as an annex to the announcement, with 101 articles organized into five titles and a final annex with the sanction grading table.

A text of 101 articles and five titles

The new ordinance is structured into five titles: general provisions; public spaces and urban landscape; behaviors affecting citizen coexistence; ownership and control of animals; and the sanctioning regime. Among the regulated matters are:

  • Public and private spaces, street furniture, graffiti and paintings, banners and advertising.
  • Green areas, games in public spaces, and unmanned aircraft systems (UAS).
  • Waste and containers, noise pollution, consumption of alcoholic beverages, and physiological needs on public roads.
  • Ownership and control of animals, including bullfighting, circus, and equestrian shows.
  • Peñas (social clubs) and garitos (temporary stalls) during patron saint festivals.

The statement of motives justifies the reform based on adaptation to new social and urban dynamics, the incorporation of situations not previously contemplated or insufficiently regulated, the response to current social demands, and the updating of infractions and sanctions, with added criteria for sustainability and accessibility.

Sanctions from 100 to 3,000 euros

Article 84 establishes three fine brackets:

  • Minor: from 100 to 300 euros.
  • Serious: from 301 to 1,500 euros, with possible total or partial suspension of the activity license for up to two years.
  • Very serious: from 1,500.01 to 3,000 euros, with closure of the establishment, activity, or installation, license suspension for up to three years, or definitive closure.

Annex I details the grading for recidivism: the first repeat offense increases the amount by 25% and the second by 50%, up to the maximum provided for in the third report. Voluntary payment within twenty business days reduces the fine by 50%, and the City Council may replace the financial sanction with training sessions, civic activities, or community service.

Allegations, civility guide, and biennial review

The file is subject to public information and a hearing for interested parties for a period of thirty days, during which allegations, claims, and suggestions may be submitted. The ordinance will enter into force once its full text is published in the Official Gazette of the Province of Huesca and the period provided for in Article 65.2 of Law 7/1985, of April 2, regulating the Bases of the Local Regime, has elapsed.

The final provisions require the dissemination of the regulation and the editing and distribution, within three months of its entry into force, of a guide on civility and citizen coexistence that identifies unlawful behaviors and the corresponding sanctions for each of them. Furthermore, the catalog of behaviors and provisions of the ordinance will be reviewed and updated every two years.

The reform affects all inhabitants of the municipal district, including minors, and reinforces the City Council’s sanctioning power over the use of public space. The period for allegations keeps the text open: contributions submitted in the next thirty days may modify its content before final approval.
