Baiona abre un expediente para aclarar a titularidade do Camiño Covaterreña

The Baiona City Council has initiated a file to investigate the ownership of Camiño Covaterreña, a road in the municipality whose property regime is to be clarified. The decision was adopted by Decree No. 2026-2897, dated October 20, 2026, signed by Mayor Jesús Vázquez Almuíña, and published in the Official Gazette of the Province of Pontevedra (BOPPO) No. 206, Monday, October 26, 2026, in the Local Administration section.

The announcement appears under the heading “Other documents, notifications and public information” of the Baiona City Council and is titled “Agreement to initiate the investigation file.” It indicates that the procedure is opened regarding “the assets or rights” detailed below, with a single description: Camiño Covaterreña, Baiona. The text does not provide cadastral data, length, boundaries, or a reference from the municipal asset inventory.

The publication of the agreement is ordered “within a period of 20 days” in the BOPPO and on the City Council’s notice board, both physical and electronic. Furthermore, the file remains available to interested parties at the municipal offices, in the General Secretariat Department.

A procedure to determine who owns the road

The initiation opens the instruction phase of an ownership investigation file, a procedure through which a local administration verifies whether an asset —in this case, a road— is municipal in nature or belongs to third parties. The result determines the City Council’s capacity to act as the owner of the road: conservation, maintenance, execution of works, and regulation of uses.

The decree does not detail the specific motivation or the background that led to the initiation of the procedure in the published announcement, nor does it identify the persons or entities that could be affected. The reference for any procedure is Decree No. 2026-2897, dated October 20, 2026.

One-month period to submit allegations

The schedule set by the announcement is as follows:

  • Publication in the BOPPO: within 20 days following the agreement, together with the display on the City Council’s physical and electronic notice boards.
  • Start of the allegations period: the day following the completion of the publication of the announcements on the Corporation’s board.
  • Duration: one month.
  • Method of submission: in writing before the municipal Corporation.
  • Required documentation: all documents on which the affected persons base their allegations.
  • Consultation of the file: City Council offices, General Secretariat Department.

Covaterreña, a unique nucleus of the municipality

Covaterreña appears as a unique population entity of Baiona in the list of sections, localities, and polling stations published in BOPPO No. 196, October 12, 2026, within section 002 of district 01, in the parish of Baiona (Santa María de Afuera). The road subject to the file takes its name from this nucleus.

The investigation of paths is a common procedure in the province’s municipalities. For instance, the Tomiño City Council agreed in the plenary session of September 24, 2026, to initiate an investigation file regarding the ownership of the path identified in the inventory as AMO-121, in Carregal de Arriba-Amorín, with a one-month period for public information; the announcement was published in the BOPPO no. 199, of October 15, 2026, under file no. 2879/2026.

In the case of Baiona, the City Council has recently received provincial funding for this type of road network: the Provincial Council of Pontevedra granted a subsidy to the Baiona City Council within the framework of the Extraordinary Plan Vía Depo for the investment “Rehabilitation and improvement of municipal paths and access itineraries to maritime environments” (File 2026044354), according to what was published in the BOPPO of September 15, 2026.

Why it matters

Clarifying the ownership of the Camiño Covaterreña determines who is responsible for its maintenance and who can decide on its uses, something that directly affects neighbors and owners of adjacent plots. Any person who considers themselves affected has one month, counted from the end of the display of the announcements on the municipal notice board, to defend their rights in writing before the City Council.
