Badajoz emplaza a los interesados en el recurso contencioso 151/2026

The Badajoz City Council has made public the summons to all interested parties in the contentious-administrative appeal processed under abbreviated procedure number 151/2026, heard before the Contentious-Administrative Section, Court number 1, of the Court of First Instance of Badajoz. The resolution is published in the Official Gazette of the Province of Badajoz (BOP) no. 194, of October 9, 2026, within the Local Administration section, under reference Announcement 3991/2026. The announcement is signed by the Mayor, Ignacio Gragera Barrera.

The origin of the procedure is the appeal filed by David Manuel Guerrero Cáceres against decree number 2026/2644, of May 20, 2026, issued by the Fourth Deputy Mayor Delegated for Human Resources of the Most Excellent City Council of Badajoz, by delegation of the Mayor according to the decree of February 2, 2024 (BOP of Badajoz no. 28, of February 8). That decree dismissed the administrative appeal filed against the final answer key for the first exercise of the selection process.

The origin of the litigation: the competitive exams for General Administration Technician

The affected selection process is the one convened for the provision of five General Administration Technician positions for the Badajoz City Council. The conflict centers on the final answer key for the first exercise, the challenge of which through administrative channels was rejected by decree 2026/2644.

Since the administrative appeal was not granted, the appellant has sought judicial recourse, which has led to abbreviated procedure 151/2026 before the contentious-administrative body of the capital of Badajoz.

Who may appear and within what timeframe

According to what was agreed in the Court resolution dated October 1, 2026, the following are summoned as interested parties:

  • All applicants whose legitimate interests may be affected by the procedure.
  • Those who participated in the selection process for the five General Administration Technician positions.
  • Any person with a direct legitimate interest in the result of the first exercise.

The summons is carried out in accordance with the provisions of Article 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction. Interested parties may appear as defendants before the indicated Court within a period of nine days starting from the day following the publication of the announcement.

The abbreviated procedure before the Court of First Instance

The appeal is processed through the steps of the abbreviated procedure, a procedural route provided for matters of lower complexity and indeterminate amount. The competent body is the Contentious-Administrative Section, Court number 1, of the Court of First Instance of Badajoz.

The publication of the summons in the BOP is the legal mechanism to ensure that all potentially affected persons are aware of the existence of the litigation and can defend their interests before a resolution is issued.

Relevance for readers

This announcement directly affects the candidates who participated in the selection process for the five General Administration Technician positions of the Badajoz City Council, as the judicial ruling could alter the answer key of the first exercise and, consequently, the development of the process. Those who do not appear within the period of nine days from the publication will remain outside the procedure and will not be able to assert their claims in this case.
