Badajoz approves the new ordinance on subsidies and transfers

The Provincial Council of Badajoz has definitively approved the new General Ordinance on Grants and Transfers, a text that renews the regulation of provincial aid after two decades. The agreement, adopted by the Plenary of the provincial Corporation in the session of June 30, 2026, is published in the Official Gazette of the Province of Badajoz number 165, of August 28, 2026, via Announcement 3400/2026.

The file was submitted for public consultation for a period of thirty business days through an announcement published in the BOP on July 7, 2026. In the absence of claims or suggestions, the agreement, which until then was provisional, is understood to be definitively approved in accordance with articles 49 and 70.2 of Law 7/1985, of April 2, Regulating the Bases of Local Government.

A regulation that replaces that of 2006

The previous ordinance was approved in 2006, in compliance with the mandate of article 17.2 of Law 38/2003, of November 17, General Law on Grants. Twenty years later, the institution has considered its revision necessary in light of accumulated experience, further expanding the text with the regulation of other forms of promotion to which the Provincial Council frequently resorts, such as prizes, scholarships, transfers, quotas, or contributions.

The new text combines in a single regulatory instrument the updated compliance with the legal mandate with the general regulation and specific provisions for those other contributions. It is organized into 86 articles distributed across five titles, four additional provisions, two transitional provisions, one repealing provision, and one final provision.

Structure and innovations

• Title I: general provisions applicable to all promotion activities, with special emphasis on the subjective scope of application and the legal regime.
• Title II: the Strategic Grant Plan, as a connection between objectives, foreseeable costs, and funding sources.
• Title III: the general regulatory bases for grants, with procedures for competitive bidding and direct award, management, payment, justification, reimbursement, and the sanctioning regime.
• Title IV: specific regimes, including contributions, quotas, prizes and scholarships, and collaboration agreements.
• Title V: innovatively, the regulation of provincial cooperation plans for the works and services of local entities, with a coordination regime and the creation of the Provincial Council/City Councils Coordination Council.

Deadlines and appeals

Against the agreement, which is now final, only a contentious-administrative appeal may be filed before the Contentious-Administrative Chamber of the High Court of Justice of Extremadura within two months from the day following the publication of the full text, in accordance with Article 112.3 of Law 39/2015, of October 1, on the Common Administrative Procedure and Articles 10 and 46 of Law 29/1988, of July 13, Regulating Contentious-Administrative Jurisdiction.

The full text of the ordinance is published as an annex to facilitate its use by legal operators, administrative units, and citizens. The document is signed by the Acting Chief Officer and Secretary General, María Fernanda Rubio Cortés.

Relevance for the province

The new ordinance unifies and simplifies the administrative processing and financial control of all provincial grants, in a territory marked by depopulation where the articulation of development policies is key. City councils, entities, and citizens applying for funds from the Provincial Council of Badajoz must henceforth adhere to this new regulatory framework, which also empowers the Presidency to establish a technical advisory body to accompany the evolution of the regulation.
