Por FactBox Admin

The Bárcena de Cicero City Council has opened the public information period for the project “Completion of widening works for La Maza Street in Adal-Treto” and the list of assets and rights considered necessary for expropriation. The agreement was adopted by the municipal Plenary in an ordinary session on September 28, 2026, and is published in the Official Gazette of Cantabria no. 196, dated October 13, 2026, section 5. Compulsory Expropriation, with official reference CVE-2026-7903 and file 1289/2026.
Initial approval and declaration of public utility
The plenary agreement initially approved the works project, deemed the execution of the infrastructure contained therein necessary, and considered the declaration of public utility implicit for reasons of improving road safety, as well as the need for occupation for the purposes of compulsory expropriation. The legal basis invoked is Article 94 of the TRRL and Article 10 of the Compulsory Expropriation Law (LEF).
In the same agreement, the specific and individualized list of affected assets and rights, included as an annex to the announcement, was initially approved. Both that list and the complete project are published on the electronic office of the Bárcena de Cicero City Council (https://barcenadecicero.sedelectronica.es).
Fifteen days to file objections
In accordance with Article 18 of the Compulsory Expropriation Law, a fifteen-day public information period is opened through announcements in:
- The City Council notice board.
- The Official Gazette of Cantabria.
- A widely circulated newspaper in the province.
- Personal notification to the interested parties.
The holders of affected assets and rights may provide in writing any data that allows for the rectification of possible errors in the published list, or oppose the occupation or disposal of the assets on formal or substantive grounds, which must be properly justified.
The two affected plots
The attached list includes two properties, both attributed to the Heirs of Daniel Cruz Canales:
- Rural plot in polygon 11, plot 173, with cadastral reference 39009A011001730000BJ: 14,805 m² according to the cadastre, of which 86.347 m² are expropriated, and no temporary occupation is foreseen.
- Urban property with cadastral reference 131102VP6015S000IX: 1,659 m² according to the cadastre, of which 134.813 m² are expropriated, without temporary occupation.
Altogether, the surface area to be expropriated amounts to 221.16 m², without temporary occupation of any land. The announcement was signed in Bárcena de Cicero on October 5, 2026, by the mayor, Gumersindo Ranero Lavín.
Impact for the owners
The publication opens the formal channel for affected parties to discuss the area being expropriated and the conditions of the occupation before the file continues its processing. As it involves urban and rural land in the nucleus of Adal-Treto, any property owner in the area with rights not included in the annex may appear during the period to correct the municipal list. The improvement of road safety is the stated reason for the work, which reinforces the public utility of the action against potential challenges.
