Call for applications to fill the position of lawyer-instructor-inspector at AVPDk

The president of the Basque Data Protection Authority (AVPD), Unai Aberasturi Gorriño, has approved, via the resolution of July 28, 2026, the call for a merit-based competition to fill two lawyer-instructor/inspector positions. The call was published in the Official Gazette of the Basque Country (BOPV) number 170, on September 7, 2026, with official reference 2026/3815.

Both positions have a destination supplement of level 27, are located in Vitoria-Gasteiz, and fall under the Superior Body (subgroup A1) – Superior Legal Faculty Scale. The call is open to civil servants of the general administration of the Basque Autonomous Community, provincial administrations, and local administrations, as well as those from public entities mentioned in Article 2 of Law 16/2023.

Position characteristics

The two places have a specialized legal profile and the following RPT codes: 008.001 and 008.008. Both belong to group A/A1, with specific supplement II-B, Basque language profile 4, and a 100% dedication regime.

The mission of the positions is:

  • To carry out instructional activities in sanctioning procedures, protection of rights, and regulatory breaches.
  • To conduct inspections of personal data processing and write minutes and assessment reports.
  • To prepare legal protection reports and proposals for administrative resolutions.
  • To provide internal legal advice to the AVPD.

Participation requirements and deadlines

Applications must be submitted within a period of 15 business days, starting from the day following the publication of the call in the BOPV, via the AVPD’s electronic registry or through public administration registries. The list of accepted and rejected applicants will be published on the AVPD’s electronic headquarters within one month, and rejected applicants will have 10 days to correct errors.

The following may not participate:

  • Those who have taken office in a position obtained through a competition in the last two years.
  • Those with a formal extension of functions.
  • Those on voluntary leave who have not completed the minimum time required for reentry.

Evaluation system

The competition consists of two phases: general merits (maximum 20 points, minimum 10 required) and specific merits (maximum 20 points, minimum 10 required). The total score is 40 points. General merits evaluate work experience, qualifications, training courses, publications, teaching activity, and seniority; specific merits, on the other hand, involve a prior test by the Evaluation Committee to measure knowledge and skills related to the position.

The evaluation will be carried out by a committee of 3 members, consisting of the head of the AVPD’s Legal Advisory Unit, the head of the General Secretariat, and one lawyer-instructor-inspector. The committee will act with independence and objectivity, and its proposals will be binding for the administration.

Appeals and consequences

Against the resolution, an appeal for reconsideration may be filed before the president of the AVPD within one month, or a contentious-administrative appeal within two months. The call shall take effect from the day following its publication in the BOPV.

This call is of particular importance for the legal sector and for civil servants wishing to work in data protection supervision, as it is an opportunity to strengthen the internal structure of the AVPD, the main autonomous body in the field of personal data protection.
