Cabes Bort plant authorized on non-urbanizable land in Valencia

Por FactBox Admin

The Third Vice-Presidency and Department of Environment, Infrastructure, Territory and Recovery of the Generalitat Valenciana has issued a favorable resolution authorizing the implementation on non-developable land, the prior administrative authorization, and the administrative construction authorization for the energy project “Cabes Bort”. The announcement is published in the Official Gazette of the Province of Valencia, number 168, dated September 2, 2026, with reference 2026/09290.

The processing corresponds to the Territorial Service of Industry, Energy and Mines of Valencia, the competent body to instruct and resolve these types of files for the implementation of energy facilities within the provincial territory. The project is processed under file ATALFE/2022/23/46, initiated in 2022.

An energy project on non-developable land

The favorable resolution covers three authorizations accumulated in a single procedure:

  • Authorization for implementation on non-developable land, which enables the occupation of land for energy uses outside of ordinary urban planning classification.
  • Prior administrative authorization, which recognizes the technical and location viability of the facility.
  • Administrative construction authorization, which allows the execution of the project works.

The figure of authorization for implementation on non-developable land is a key instrument of Valencian regulations to make the deployment of energy facilities compatible with the protection of the territory, by subjecting these projects to specific environmental and territorial control prior to their construction.

Processing and competent body

File ATALFE/2022/23/46 has been resolved favorably, which implies that the regional administration considers that the project meets the requirements demanded for its location on non-developable land. The resolution falls within the competencies of the Department of Environment, Infrastructure, Territory and Recovery, acting through its Territorial Service of Industry, Energy and Mines of Valencia.

The announcement published in the provincial gazette serves as a public notification, making the resolution known for publicity purposes and, where applicable, for any corresponding appeals against it.

Territorial and environmental relevance

The authorization of an energy project on non-developable land in the province of Valencia has a direct impact on the territory and landscape of the affected region, as it is an implementation that deviates from the ordinary uses of rural land. The decision of the regional administration sets a precedent regarding the criteria applied to this type of facility and the balance between the development of energy infrastructure and the preservation of non-developable land.

For the municipalities and residents of the area, the resolution opens the door to the construction of the plant, a process that will be subject to the environmental and territorial conditions set forth in the authorization itself. The publication in the Official Gazette of the Province of Valencia guarantees the transparency of the procedure and the citizens’ access to the information in the file.
