Asturias increases legal aid scales by 1.5%

The Regional Ministry of Finance, Justice and European Affairs of the Principality of Asturias has updated by 1.5% the amounts received by legal aid professionals for free legal assistance, with economic effects from January 1, 2026. The measure is detailed in the Resolution of August 28, 2026, published in the Official Gazette of the Principality of Asturias (BOPA) No. 172, of September 4, 2026, and signed by the regional minister Guillermo Peláez Álvarez.
The update applies to the amounts in force as of December 31, 2025, and stems from the Agreement of the Governing Council of July 6, 2026, which set a 1.5% increase in the remuneration of personnel serving the regional Administration for this fiscal year. The increase is transferred to the modules and bases of economic compensation in Annex II of the Regulation of Free Legal Assistance in the Principality of Asturias (RAJG), approved by Decree 13/2020, of May 7, and modified by Decree 73/20, of October 15.
Regulatory Framework
The right to free justice is anchored in Article 119 of the Spanish Constitution and is developed in Law 1/1996, of January 10, on Free Legal Assistance (LAJG). Article 37 thereof obliges the competent administrations to subsidize the implementation and operation of these services through the Bar Associations and Court Representative Associations.
Competence corresponds to the Principality by virtue of Royal Decree 966/2006, of September 1, which transferred the recognition of the right and the management of legal aid indemnities. Article 39.3 of the RAJG itself provides for the automatic annual update of the amounts in accordance with the increase in the remuneration of civil servants, via a resolution from the regional ministry competent in justice.
New Amounts
The 1.5% increase applies to all scales in Annex II. Among the main references for lawyers:
- Individualized assistance to a detained person: €111.75.
- 24-hour on-call service: €201.85.
- General criminal procedure: €426.53; abbreviated procedure: €318.40.
- Ordinary civil trial: €380.88; verbal trial: €263.14.
- Cassation appeal: €394.09; civil and criminal appeal: €183.84.
- Assistance to the Free Legal Assistance Commission: €92.53 per meeting.
For court representatives (procuradores), the amounts are €60.08 in jury court proceedings and €39.65 in other criminal proceedings, and €52.87 in civil jurisdiction. Regarding operating expenses, the Bar Association will receive €47.47 per processed file and the Court Representative Association, €5.41.
Background and Effects
This is the second consecutive update of the scales: by Resolution of April 14, 2026, an increase of 2.5% had already been applied, effective from January 1, 2025, to the amounts in force as of December 31, 2024. The new resolution, which exhausts administrative remedies, may be appealed through contentious-administrative proceedings before the Contentious-Administrative Chamber of the High Court of Justice of Asturias within a period of two months.
The increase ensures that the remuneration of those providing the public legal aid service in Asturias keeps pace with the remuneration of civil service personnel, preserving the sustainability of the court-appointed system and access to judicial protection for those who prove insufficient resources to litigate.
