Asturias will pay 15,622.68 euros to Clece Mayores for late payment interest
Por FactBox Admin

The Department of Social Rights and Welfare of the Principality of Asturias has ordered the execution of judgment 640/2026 from the Contentious-Administrative Chamber of the High Court of Justice of Asturias (TSJA), which recognizes the right of UTE Clece Mayores, S. L. U.-Azvase, S. L. to receive 15,622.68 euros in late payment interests and expenses. The decision was signed by the regional minister Nerea Monroy Rosal on September 30, 2026, and published in the Official Gazette of the Principality of Asturias (BOPA) no. 200, dated October 15, 2026, under official reference 2026-08142.
The origin: a claim dismissed by silence
The conflict began with an administrative claim filed on December 17, 2025, by UTE Clece Mayores, S. L. U.-Azvase, S. L. before the Department of Social Rights and Welfare, in which it demanded the payment of late payment interests and compensation for collection costs derived from a contract with the regional Administration.
That claim never received an express response: the Department presumably dismissed it through administrative silence. In response to this inactivity, the company filed a contentious-administrative appeal, which was processed as ordinary procedure 60/2026 before the Contentious-Administrative Chamber of the TSJA.
What the court resolved
Judgment 640/2026, issued on July 7, 2026, partially upheld the appeal and annulled the presumed dismissal for being contrary to law. The ruling recognizes the appellant’s right to collect the claimed late payment interests and expenses, with the following terms:
- Recognized amount: 15,622.68 euros in late payment interests and expenses.
- The payment of legal interest on the already overdue interests is not applicable.
- No court costs are imposed on either party.
- The company was represented by the court agent Mr. A. M. A.-L.
Execution of the judgment
Once the judicial resolution became final, the Department now orders the execution of the ruling “on its own terms,” in accordance with Article 26 of Decree 20/1997, of March 20, which regulates the organization and functioning of the Legal Service of the Principality of Asturias.
The resolution consists of two sections: the first orders the execution of the literal wording of the judgment, and the second provides for its publication in the BOPA. The document appears in Section I, “Other Provisions,” and bears the code 2026-08142.
This case adds to other recent rulings by the same Department regarding claims for late payment interests from contractors of socio-sanitary services, illustrating a pattern of payment delays to providers within the elderly care system.
Impact for the reader
The publication confirms that the Principality of Asturias must pay 15,622.68 euros from public funds to UTE Clece Mayores, S. L. U.-Azvase, S. L., in addition to assuming the administrative and judicial wear and tear of having left a legitimate claim unanswered. The episode illustrates the cost that administrative silence and payment delays add to the regional coffers: interests are now added to the original invoice, increasing the cost of the service contracted by the Department of Social Rights and Welfare.
