ASIC Moves to Deregister Four Managed Funds Two Months After Gazette Notice

ASIC has given notice that it may deregister four registered managed investment schemes two months after publication of the notice, unless it is given an acceptable reason not to proceed. The warning covers the Daintree Hybrid Opportunities Active ETF, the Impax Global Opportunities Fund, the Mainstream Separately Managed Account and the NovaPort Smaller Companies Fund. It was published in the ASIC Gazette, Commonwealth of Australia Gazette No. A42/26 of Tuesday 20 October 2026, at page 15, under subsection 601PB(2) of the Corporations Act 2001, and is dated 16 October 2026.

The notice sits in the “Company/scheme deregistrations” section of the edition, the standing channel through which ASIC publishes corporate and scheme actions taken under the Corporations Act 2001. The gazette is issued by the Australian Securities and Investments Commission and carries the online ISSN 1445-6060. The four matters appear in the edition’s contents under “Notices under Corporations Act 2001” as items 26-0827, 26-0844, 26-0846 and 26-0848.

The four schemes named

Each scheme is identified in the notice by name and by its Australian Registered Scheme Number, the identifier investors use to trace a fund through the register:

  • Daintree Hybrid Opportunities Active ETF — ARSN 651 905 314
  • Impax Global Opportunities Fund — ARSN 664 065 141
  • Mainstream Separately Managed Account — ARSN 631 635 473
  • NovaPort Smaller Companies Fund — ARSN 094 601 475

The list spans very different vintages of the register: the NovaPort Smaller Companies Fund carries an ARSN in the 094 series, while the Daintree Hybrid Opportunities Active ETF and the Impax Global Opportunities Fund sit in the 651 and 664 series respectively.

A two-month window to object

The operative sentence is short and conditional. ASIC “may deregister the managed investment schemes listed below two months after the publication of this notice, unless given acceptable reason not to proceed.” Measured from the 20 October 2026 publication date, that window closes on or about 20 December 2026.

The notice does not set out a form, fee or address for lodging a reason, and it does not state the grounds on which ASIC is acting against each individual scheme. What it does do is fix the deadline and place the onus on anyone with an interest in the schemes to come forward before it expires.

The edition also carries a standing statement of rights of review. Persons affected by certain decisions made by ASIC under the Corporations Act 2001 and other legislation it administers may have review rights, and the commission points readers to Regulatory Guide 57 Notification of rights of review (RG57) and Information Sheet ASIC decisions – your rights (INFO 9). Both are available from the ASIC Digest, from www.asic.gov.au, or from the Administrative Law Co-ordinator in the ASIC office handling the matter.

Other deregistrations in the same edition

The scheme notice is one of several register actions in the 20 October 2026 gazette, all dated 16 October 2026:

  • Apex Australia Charitable Fund Incorporated (ARBN 057 197 314) will be struck off under section 601CC(3) three months after publication unless an acceptable reason is given.
  • Advanced Microbial Solutions, L.L.C. (ARBN 621 789 062), Cegelec Oil & Gas (ARBN 609 973 800) and Trademax Global Markets (International) Pty Ltd (ARBN 668 323 411) face removal under section 601CL(4) on the same three-month basis.
  • HCL Software Products Limited (ARBN 151 578 808), Industrial Growth Platform Pte. Ltd. (ARBN 638 633 208) and Interrupt Labs (Australia) Limited (ARBN 663 160 807) have already been struck off under section 601CL(5).

Why it matters for unit holders

For retail investors, the practical consequence is that four named funds are on a clock. Deregistration of a registered scheme is the formal end of its existence as a registered entity, and the notice gives unit holders, responsible entities and advisers roughly two months to establish whether the schemes are still operating, whether their interests are protected, and whether there is a reason ASIC should be told about. Anyone holding an interest in an ARSN on the list should treat 20 December 2026 as the operative date and act well before it.
