Por FactBox Admin

The Arrabalde City Council has finalized the amendment of Article 6 of the fiscal ordinance regulating the tax for the occupation of public roads with goods, construction materials, rubble, fences, scaffolding, and other similar installations. The agreement, initially approved by the Plenary on August 7, 2026, received no claims during the public exhibition period and has therefore been made final. The announcement is published in the Official Gazette of the Province of Zamora No. 116, dated October 5, 2026, under reference R-202602309.
Processing: from provisional to final
The Plenary of the Arrabalde City Council, in an extraordinary session on August 7, 2026, provisionally approved the amendment of the fiscal ordinance. The file was submitted for public consultation for a period of thirty days from the day following the insertion of the announcement in the Official Gazette of the Province of Zamora No. 93, dated August 12, 2026 (R-202601976), so that interested parties could examine it and present any allegations they deemed appropriate.
After this period elapsed without any claims being filed, the agreement was automatically finalized, in accordance with Article 17.4 of the Recast Text of the Law Regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5. The final announcement was signed in Arrabalde on September 30, 2026, by the Mayor.
New rates for occupying public roads
Article 6 of the ordinance is drafted with the following rates, based on the duration of occupation:
- Occupation with rubble, soil, sand, construction materials, firewood, or any other materials, for a period of one week: 25 euros.
- For a period of one week up to one month: 50 euros.
- For a period of one month up to three months: 100 euros.
- For a period of more than three months up to one year: 150 euros.
The scale therefore ranges from 25 to 150 euros depending on the duration of the occupation. The measure affects residents and companies carrying out works that need to deposit materials or install fences and scaffolding on the municipality’s public roads.
Allegations and appeals
A contentious-administrative appeal may be filed against the final agreement before the Contentious-Administrative Chamber of the High Court of Justice of Castilla y León within two months, counting from the day following the publication of the announcement, according to Article 19 of the Recast Text of the Law Regulating Local Treasuries.
The full text of the ordinance is made public in compliance with Article 17.4 of said regulation. The file is available to any interested person at the municipal offices and on the electronic headquarters of the Arrabalde City Council.
With the final publication, the Arrabalde City Council concludes the processing of a tax that directly levies construction activity within the municipality. Residents and construction companies that occupy public roads with materials, rubble, fences, or scaffolding must adjust their cost forecasts to the new scale, which penalizes longer occupations and is already applicable following its publication in the provincial bulletin.
