Por FactBox Admin

The Official Gazette of Aragon publishes this October 15, 2026, Order ECE/1470/2026, of September 22, which specifically declares the public utility of the “Azabache” wind farm and its evacuation infrastructure, in the municipality of La Puebla de Valverde (Teruel). The decision is signed by the Councilor for Economy, Competitiveness, and Employment, Eva Valle Maestro, and enables the compulsory expropriation of the assets and rights necessary to execute the installation. The order appears in issue number 200 of the gazette, section III, with the official reference BOA20261015019.
The declaration is based on Article 54 of Law 24/2013, of December 26, on the Electricity Sector, which recognizes the public utility of electrical generation, transmission, and distribution facilities for the purposes of compulsory expropriation and the imposition and exercise of easements. At the regional level, the competence corresponds to the Councilor for Economy, Competitiveness, and Employment according to Article 23 of Decree-law 2/2016, of August 30, following the processing of the file by the Provincial Service of the province where the installation is located. The procedure is completed by Royal Decree 1955/2000, of December 1, and Law 39/2015, of October 1, among other applicable regulations.
The file accumulates two references: G-T-2022-005 and DUP-T-2025-0016. The installation already had prior administrative and construction authorization, granted by Resolution of December 17, 2024, from the Director General of Energy and Mines, published in the Official Gazette of Aragon number 6, of January 10, 2025.
A year-and-a-half processing period
The company Yequera Solar 7, SL requested the declaration of public utility on January 31, 2025. The company submitted documentation on February 3 and December 22, 2025, and provided the final documentation on March 25, 2026. Additionally, it registered responsible declarations regarding agreements reached with owners before the public information period on three dates:
- November 12, 2025.
- February 4, 2026.
- March 31, 2026.
The request was submitted for public information via an announcement in the Official Gazette of Aragon number 79, of April 28, 2026, in the Diario de Teruel of the same date, on the notice board of the affected town hall, and on the Government of Aragon website, where the report and the annex of affected properties were published. The promoter was also notified, the competent administrations and bodies were informed, and affected parties were individually notified according to the list of affected assets and rights. No objections were received during the process.
The Provincial Service of Teruel issued a report on June 23, 2026, which detailed the procedures carried out, provided a favorable report on the specific recognition of public utility, and determined the list of assets and rights considered necessary for expropriation.
Expropriation and right of way
The declaration extends to the effects of compulsory expropriation of the assets and rights necessary for the establishment of the installation and to the imposition and exercise of the right of way set forth in Annex I of the order. Pursuant to Article 56 of Law 24/2013, the declaration implies the necessity of occupying the assets or acquiring the affected rights and implies urgent occupation for the purposes of Article 52 of the Law of December 16, 1954, on compulsory expropriation.
The order further recognizes the promoter’s right to obtain the appropriate authorization for the establishment, passage, or occupation of the installation on lands under public domain, use, or service, or state assets, those of the autonomous communities, or public, private, or communal lands of the province or municipality, as well as on its public works, services, and easement zones.
Two affected properties in La Puebla de Valverde
Annex I details the list of affected assets and rights, with two properties in the municipality of La Puebla de Valverde:
- Property 23, polygon 37, plot 86, pastureland, owned by Arturo Soriano Ros and Noé Soriano Ros: 5.47 linear meters of underground line, 3.28 square meters of surface area, 19.34 square meters of surveillance and maintenance access, and 0.08 square meters of temporary occupation.
- Property 37, polygon 68, plot 24, dry farmland, owned by María Conejos Blasco: 46.71 linear meters of underground line, 28.03 square meters of surface area, 169.75 square meters of surveillance and maintenance access, and 70.96 square meters of temporary occupation.
Deadlines for appeal
The order exhausts the administrative route according to Article 60 of Law 5/2021, of June 29, on the Organization and Legal Regime of the Autonomous Public Sector of Aragon. An optional appeal for reversal may be filed before the same body that issued it within one month from the day following its notification, or a contentious-administrative appeal may be filed before the Contentious-Administrative Chamber of the High Court of Justice of Aragon within two months, provided that both are not pursued simultaneously.
The resolution orders the notification of the order to all interested parties and its publication in the Official Gazette of Aragon.
The publication closes the administrative route for a project that already had construction authorization and can now activate the urgent occupation of the land. For the owners of the two estates included in Annex I, the expropriation calendar remains open; for the region, the order consolidates a new wind farm in the south of Teruel and reinforces the regional framework for the processing of renewable installations.
