The head of the Labor Inspectorate of Álava, Sonia Holgado Arín, has announced the initiation of a sanctioning procedure for infringements of the social order against several companies. Since personal notification was not possible, the announcement had to be published in the Official Gazette of the Basque Country (BOPV), in issue number 196 dated October 14, 2026, with official reference 2026/4268. The date of the decision is September 28, 2026.

The announcement is signed by the Department of Economy, Labor and Employment of the Basque Government, and is located in the “Other official announcements” section. The procedure has been published under the protection of Article 44 of Law 39/2015, as personal notification was not possible; Article 46, on the other hand, regulates the procedure that interested parties must follow to become aware of the full content of the act.

Procedure to access the content of the act

Interested parties must present themselves at the Labor Inspectorate of Álava, located at General Álava street 10, 2nd floor, Vitoria-Gasteiz, to access the full content of the act.

  • Schedule: From 09:00 to 14:00, Monday to Friday.
  • Deadline: A maximum of 20 calendar days from the publication of the announcement.
  • Notifications will take effect from the day following their publication.

Origin of the sanctioning procedure

The procedure originates from infringements of the social order and has been verified through an infringement report and/or a proposal for the liquidation of Social Security contributions. This is the formula contained in the title of the announcement: initiation of a sanctioning procedure for infringements of the social order, verified by an infringement report and/or a proposal for the liquidation of Social Security contributions.

The annex attached to the announcement contains five notification references, all from the territorial unit of Álava:

  • Kotrik Industrial Lda. — ID/NIF 515660710 — reference I12026000029069.
  • Stocco Lda. — ID/NIF 517884747 — reference I12026000028766.
  • Stocco Lda. — ID/NIF 517884747 — reference I12026000028867.
  • Triunfo Soalheiro Lda. — ID/NIF 516781642 — reference I12026000034527.
  • One interested party, ID/NIF 04308830X, unnamed — reference I12026000038870.

Similar announcements and context

Similar announcements have been published in the BOPV in recent weeks, signed by the inspectorates of all historical territories: Biscay on September 10, 2026, Gipuzkoa on September 11, and Álava on September 18. This shows that the failure of personal notification is common in this type of procedure.

The text of the announcement itself states that the notifications will take effect from the day following their publication and that it serves as direct notification to the interested parties. That is, the publication does not interrupt the procedure, and failure to appear even after the deadline has passed does not stop the procedure.

Consequences

For the interested company, this advertisement is the sole means of notification of the procedure, as personal notification has proven impossible. Once a period of twenty calendar days has elapsed, this act shall be considered as notification and the sanctioning procedure will continue, without the company having exercised its option to object.
