Anglès requests a ruling to annul the classification of 142 cultural assets

The City Council of Anglès has requested a mandatory opinion from the Legal Advisory Commission of the Generalitat de Catalunya to ex officio review the classification of 142 cultural assets of local interest (BCIL) and 5 protected assets in the municipality. The Official Gazette of the Province of Girona publishes the request in issue 185, dated September 25, 2026 (edict 8214, CVE BOP-2026_0_185_8214), along with the suspension of the deadline for resolving the case. The decision stems from Mayoral Decree 2026DECR000497, dated April 16, 2026.

The procedure affects the list of assets “Level 2 – Cultural assets of local interest (BCIL)” and “Level 3 – Protected assets” collected in article 301 of the Municipal Urban Planning Plan (POUM) of Anglès. According to file X2024002328, the review is proposed because these assets were not classified following the legally established procedure.

The request is framed within Law 5/2005, of May 2, of the Legal Advisory Commission, specifically articles 8.3.c, 10 and following.

Mandatory opinion and suspension of deadlines

The municipal decree agrees to transfer file X2024002328, “indexed, ordered, paginated and authenticated,” to the Legal Advisory Commission. It also suspends the six-month deadline to resolve the ex officio review procedure, in accordance with article 11 of Law 5/2005.

• Suspended deadline: six months, or until the legal deadline for the issuance of the opinion expires.
• Resumption: proceedings will resume when this deadline ends.
• Legal basis: articles 8.3.c, 10 and following, and 11 of Law 5/2005.

Proposal for nullity and new special plan

The fourth point of the decree approves the Proposed Resolution for the declaration of absolute nullity of the list of assets. The proposal includes:

• Declaring the list of 142 BCIL and 5 protected assets of article 301 of the POUM null and void.
• Notifying the resolution to the Department of Culture of the Generalitat de Catalunya.
• Sending a copy to the Legal Advisory Commission, to comply with article 13.5 of Law 5/2005.
• Charging the Department of Territorial Services of the Anglès City Council with the initiation of the file to prepare and process a Special Urban Plan for the Cultural Heritage of Anglès.

Public consultation of the file

The documentation can be consulted electronically at the electronic office of the City Council (www.angles.cat) and in person at the Department of Urban Planning, from Monday to working Fridays from 9:00 to 14:00 hours, by appointment. The announcement is signed by the mayor, Jordi Pibernat Casas, with an electronic signature dated September 17, 2026.

The ex officio review leaves the urban planning protection of 147 heritage elements of Anglès in limbo until the Legal Advisory Commission issues its opinion and the new Special Urban Plan for Cultural Heritage is processed, which will have to re-catalog the assets that technically require it.
