ANA registers water concession for Lácteos de Acoyapa for five years

The National Water Authority (ANA) registered in the National Public Registry of Water Rights and Service Providers the concession title for the utilization of groundwater from a well in favor of the commercial company Desarrollo Lácteos de Acoyapa, S.A. The certification is contained in Administrative Resolution No. RAE-ANA-DGRH-0136-2026, issued on August 21, 2026, and notified on September 23 of the same year, and was published in La Gaceta, Official Gazette No. 196 on Monday, October 26, 2026, under registration Reg. 2026-01047.

The legal framework of the registration

The registration is supported by Law No. 620, “General Law of National Waters,” published in La Gaceta, Official Gazette No. 169 on September 4, 2007, and Law No. 1046, “Law of Reform to Law No. 620,” published in the Official Gazette No. 217 on November 23, 2020. The registrar also acts based on Administrative Resolution No. 140-2019, “Appointment of the National Public Registrar of Water Rights,” issued on December 20, 2019.

The procedure was submitted on September 23, 2026, by engineer Roxana Vanessa Martínez Izaguirre, acting as the special proxy of the company. Legal standing is accredited by Public Deed number 31, signed on February 16, 2023, before the notary offices of Kevin Sáenz Elizabeth, and by the Testimony of Public Deed number 21, signed on March 2, 2026, before the offices of Ricardo Ismael Alemán León.

A well in the San Juan River basin

The Second Resolve of the resolution takes note of the utilization at the point designated as “LACASA Well No. 1,” with the following technical characteristics:

• Basin: No. 69, named “San Juan River.”
• Location: municipality of Acoyapa, department of Chontales.
• UTM WGS84 Coordinates: 709626 E – 1312582 N.
• Maximum annual utilization volume: 30,617.00 m³.
• Authorized use: human consumption attached to commercial and industrial activity.
• Validity: five (05) years from the date of notification.

The registration was recorded under Perpetual Number 0108, Folio 146, Volume VII, of the Book of Registration of Concession Titles, with the registry reference RPNDAPS-LITC-ITC-0108-2026.

Publication and signature of the registrar

The certification was signed by Luis Fernando Yescas García, National Public Registrar of Water Rights and Service Providers, in Managua, at two forty-eight in the afternoon on September 23, 2026, on two single-sided sheets of common paper. The Seventh Resolve of the registered resolution establishes that the certification “must be published in La Gaceta, Official Gazette, within a maximum period of fifteen (15) calendar days.”

In the same section of the National Water Authority, another certification was published, corresponding to Administrative Resolution No. RAE-ANA-DGRH-0156-2026, which modifies a groundwater concession title for a well granted to Opportunity International Nicaragua, Inc through Administrative Resolution RAE-ANA-DGRH-0038-2023, for agricultural use and UTM WGS84 coordinates 612446 E – 1317845 N.

Issue number 196 of the Official Gazette, corresponding to Year CXXX, has 116 pages and a print run of 640 copies, with a value of 45 córdobas.

The publication formalizes the right to use the water resource and sets a verifiable annual extraction ceiling, allowing the company to operate with legal backing and the authority to monitor the volume effectively captured in an aquifer of the San Juan River basin, where industrial, commercial, and human consumption users converge.
