ANA registers temporary water authorization in favor of FOMAV in Chinandega

The National Public Registry of Water Rights and Service Providers of the National Water Authority (ANA) registered Administrative Resolution No. RAE-ANA-DGRH-0159-2026, which authorizes the temporary use of surface waters from an intake in favor of the Road Maintenance Fund (FOMAV). The certification is published in La Gaceta, Official Gazette No. 184 on Thursday, October 8, 2026, under reference RPNDAPS-LITC-ITC-0114-2026 (Reg. 2026-00974). The granted right is valid for 260 calendar days and covers routine maintenance works on the Chinandega Roundabout–Corinto section.

The resolution was issued on September 3, 2026, and notified on October 2, 2026, the date from which the validity period begins. The registration was recorded under Perpetual Number 0114, folios 168 and 169, Volume VII of the Concession Title Registration Book maintained by the National Public Registry of Water Rights and Service Providers.

The application was submitted on October 2, 2026, by Norland Javier Quezada Palacios, accredited via Contract No. DEP30-119-2026, signed between FOMAV, represented by engineer Carlos Roberto Silva Cruz in his capacity as Executive Director, and Benjamín José Lanzas Somarriba, General Administrative Proxy of the commercial company B. Lanzas Contratistas Civiles, S.A.

Road works and scope of the permit

The declared destination of the flow is the Chinandega Roundabout–Corinto section, with a length of 20.81 kilometers, within Group No. 16 of routine maintenance works. This is a temporary authorization and not a permanent concession title; therefore, the use is subject to the fixed term and the registered technical conditions.

The permit applies to surface waters from a single intake, with a limited annual volume, which restricts the use to road conservation tasks and not to other productive purposes.

Legal framework and official publication

The certification invokes Law No. 620, “General Law of National Waters,” published in La Gaceta, Official Gazette No. 169 on September 4, 2007, and Law No. 1046, “Law of Reform to Law No. 620, General Law of National Waters,” published in La Gaceta, Official Gazette No. 217 on November 23, 2020. It is also based on Administrative Resolution No. 140-2019, “Appointment of the National Public Registrar of Water Rights,” dated December 20, 2019.

The Sixth Resolve of the registered resolution orders the issuance of the certification and its publication in La Gaceta, Official Gazette within a maximum period of 15 calendar days. The document was signed by Luis Fernando Yescas García, National Public Registrar of Water Rights and Service Providers of the ANA, in the city of Managua, at 11:20 in the morning on October 2, 2026, with a publication value of C$ 290.00.

The authorization directly interests the residents of El Realejo and the users of the Chinandega–Corinto highway, who will see maintenance work carried out using water captured from the San Isidro River during the coming months. The registry entry provides legal certainty to FOMAV against third parties and sets a verifiable extraction limit, such that any use other than road maintenance or exceeding the authorized volume falls outside the protection of the resolution.
