Amposta delegates the mayoral functions to Ramon Nadal for ten days
Por FactBox Admin

The City Council of Amposta has delegated all mayoral functions to the second deputy mayor, Ramon Nadal Fabra, during October 27 and November 6, 2026, both inclusive, due to the absence from the municipality of the mayor, Adam Tomàs i Roiget. The Mayoral Decree number 20206005062, signed on October 7, 2026, is published in full in the Official Gazette of the Province of Tarragona on October 19, 2026 (CVE 2026-09392, pp. 2-3). The substitution falls to the second deputy because the first deputy mayor, Núria Marco Selma, will also be absent from the municipality throughout the entire period.
The text recalls that legislation allows for the substitution of the mayor in all their functions, and in the order of their appointment, by the deputy mayors in cases of absence, illness, or impediment, through express delegations. The current order stems from Mayoral Decree number 1791/2023, issued on June 28, 2023, which appointed the councilors who are part of the Local Government Board as deputy mayors.
A simultaneous absence that forces skipping a step
The decree outlines three linked circumstances that explain why the delegation does not fall to the first deputy:
- The mayor, Adam Tomàs i Roiget, will be absent from the municipality and unable to exercise mayoral functions between October 27 and November 6, 2026.
- The first deputy mayor, Núria Marco Selma, will also be absent from the municipality on the same dates.
- The current order of appointment places Ramon Nadal Fabra next as the second deputy mayor.
The order of precedence established in 2023 is as follows: Núria Marco Selma as first deputy mayor, Ramon Nadal Fabra as second deputy mayor, and Inés Martí Herrero as third deputy mayor. With the first two positions outside the municipality, the substitution passes directly to the second deputy.
Ten days with all competencies delegated
The first section of the resolution delegates to Ramon Nadal Fabra «the totality of the functions corresponding to this Mayoralty of the City Council» due to the mayor’s absence. The delegation therefore covers the entire time span from October 27 to November 6, 2026, both days inclusive, and is not limited to specific acts or determined matters.
The measure has an immediate precedent in the same municipality: Mayoral Decree number 20206004723, of September 19, 2026, delegated mayoral functions to the first deputy, Núria Marco Selma, for September 21 and 22, 2026, published in the BOPT on October 1, 2026 (CVE 2026-08836). In that case, the absence lasted two days and did not coincide with that of the second deputy.
Processing, acceptance, and account retention
The decree establishes a four-step procedure for the delegation to become effective:
- Notification of the resolution to the interested party.
- Acceptance by the delegated body, which is understood to be granted tacitly if no express statement of non-acceptance is made within a period of three business days from the day following the notification.
- Publication in the Official Gazette of the Province of Tarragona, without prejudice to the resolution being effective from the day following the date of signature, and publicity on the transparency portal in accordance with article 9.1.a) of Law 19/2014.
- Report to the Plenary in the next session to be held.
The invoked regulatory framework includes Law 7/1985, regulating the bases of the local regime; Legislative Decree 2/2003, approving the revised text of the Municipal and Local Regime Law of Catalonia; Royal Decree 2568/1986, approving the Regulation on the organization, operation, and legal regime of local entities; Law 40/2015, on the legal regime of the public sector, and Law 19/2014, on transparency. Specifically, article 23.3 of Law 7/1985 and article 55 of the Catalan revised text attribute to the deputy mayors the substitution in cases of vacancy, absence, or illness, while article 47.1 of the state regulation extends this to all functions.
For the residents of Amposta, the decree determines who will sign resolutions, convene and preside over municipal bodies, and exercise the representation of the City Council during ten days at the end of October and beginning of November. The coincidence of the absence of the mayor and the first deputy mayor is the element that makes this substitution exceptional, as it shifts competencies to the second deputy mayor and temporarily alters the effective composition of the Local Government Board.
