Almoharín approves the fee for the use of municipal facilities

The Almoharín City Council has finalized the fiscal ordinance regulating the fee for the temporary or sporadic use of municipal buildings, premises, and facilities, as no claims were submitted during the public exhibition period. The regulation, signed by the Mayor-President Antonia Molina Márquez on August 21, 2026, is published in full in the Official Gazette of the Province of Cáceres number 163, dated August 26, 2026, and comes into force the day following its publication.
The Plenary of the council agreed to the initial approval in an ordinary session held on June 24, 2026, submitting the file for public information for a period of thirty business days via an announcement published in the BOP number 129, dated July 9, 2026, and on the entity’s notice board. Since no objections were registered, the agreement was automatically finalized in compliance with article 17.4 of the Recast Text of the Law Regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5.
Rates by type of use
The tax quota is determined according to the activity and the intended use of the municipal public service assets:
- €35.00 per day of use of public buildings for educational, training, recreational, or similar activities when an admission fee is charged to the public.
- €25.00 per day when no admission fee is charged to the public.
- €100.00 per day for private or individual commemorations, parties, leisure events, or similar.
In addition to the payment of the fee, users must deposit a bond of €100.00, which will be returned after verifying that no damage has occurred and that the cleaning of the premises and their surroundings has been carried out. Each day of delay without justified cause in the return of keys or the handover of the facility will result in a deduction of €50.00 from the bond.
Exemptions and applications
Events organized by the City Council itself are exempt from the payment of the fee and the deposit of the bond, even if their organization has been delegated to associations or companies, as well as official protocol acts, political party events, and board meetings, partner assemblies, or commemorations of local associations. Non-profit activities or those of social interest declared by the council, as well as teaching activities taught by technicians or monitors registered in the locality for students of the municipality, also do not constitute a taxable event.
Applications for events included in clause B of the fee must be submitted a maximum of 30 calendar days prior to the event, and the City Council must resolve them within a period of 5 calendar days. The council retains priority in the use of the buildings, even when their use has been temporarily assigned.
Sanctions Regime
The ordinance classifies infractions as very serious, serious, and minor, with the following penalties:
- Very serious infractions: up to €3,000.00.
- Serious infractions: up to €1,500.00.
- Minor infractions: up to €750.00.
The penalties are independent of any applicable compensation for damages. Notable prohibitions include occupying the helipad space, using the premises for purposes other than those authorized, assigning use without municipal consent, or conducting sales and distributing third-party propaganda inside the enclosures.
The new fee represents a step in the regulation of the use of the municipal public domain of Almoharín, providing legal certainty to individuals and associations requesting the assignment of spaces for cultural, social, or festive activities, and guaranteeing the council the coverage of expenses derived from their use and maintenance.
