Allariz cobra 6.000 euros aos bancos polos seus caixeiros automáticos

The Allariz City Council will charge 3,000 euros to Banco Sabadell, S.A. and another 3,000 euros to Banco Santander for the occupation of the local public domain by the ATMs installed on the facades of their offices. This is stated in the collection list for the 2025 and 2026 fiscal years approved by decree of the mayor, M.ª Cristina Cid Fernández, on October 29, 2026, and published in the Official Gazette of the Province of Ourense on November 3, 2026, in section IV. Local Entities (reference R. 2.621).

The tax levies the special use of public domain land that the placement of ATMs on the facades of banking establishments with direct access from the public road entails. The decree is based on a municipal tax ordinance approved by the Plenary in the session of October 25, 2013, initially published in BOP number 251, of October 31, 2013, and definitively in BOP number 287, of December 16, 2013. The regulation has, therefore, been in force for thirteen years.

The decree invokes articles 3, 4, 6, 8, and 10 of the ordinance and the powers attributed to the mayor by article 21.1.f) of Law 7/1985, of April 2, regulating the bases of the local regime. The resolution is dated October 30, 2026, and is electronically signed by the mayor.

Two ATMs and 6,000 euros in revenue

The approved collection list includes two entities, with an identical amount for each and a total of 6,000 euros:

  • Banco Sabadell, S.A., ATM at Emilia Pardo Bazán street, number 32, ground floor: 3,000.00 euros.
  • Banco Santander, ATM at Campo da Barreira street, number 1, ground floor: 3,000.00 euros.

In each case, the address identifies the location of the taxable event, that is, the point of the public road occupied by the ATM. The document does not detail the number of ATMs per entity nor the exact period of occupation that justifies each settlement, but only the global amount per accumulated fiscal year.

Fifteen days of public exhibition

The second point of the decree orders the collection list to be submitted to public exhibition for 15 days, which will begin to count from the publication of the announcement in the BOP. Within this period, interested persons or entities may present the allegations or claims they deem appropriate.

Once the period has elapsed without allegations, the council will carry out the corresponding settlements and notify the interested banking entities. An appeal for reversal may be filed against the data in the list and against the tax settlements, under article 14.2 of the revised text of the Law regulating local finances, within a period of one month from the end of the public exhibition and before the mayor, or any other appeal that is considered appropriate.

A precedent for the rest of the councils

The publication makes Allariz a visible example of the use of municipal fees on the public domain to make financial entities pay for the installation of ATMs on the streets. The model is already extended to other municipalities, but each council must have a specific ordinance and subsequently approve the concrete collection list, a step that the Allariz council is now taking for the 2025 and 2026 fiscal years.

For the residents, the news has an indirect but relevant effect: it consolidates a municipal revenue stream that taxes the private use of the public road by companies external to the council. For the two affected entities, it opens a short period of 15 days to review the published data and, afterwards, one month to appeal the settlements before the mayor.
