ADIF corrects errors and expropriates new properties for the AVE in Lantarón and Ribera Baja

ADIF-Alta Velocidad, an entity dependent on the Ministry of Transport and Sustainable Mobility, has published in the Official Gazette of the Historical Territory of Álava (BOTHA) number 102, dated September 7, 2026, a notice for the correction of errors in the public information regarding the declaration of the need for occupation for the Madrid-Basque Country-French Border High-Speed Line project. The notice incorporates properties that were omitted in the initial publication and opens a period of fifteen business days for affected owners to submit allegations.

The correction refers to the Burgos-Vitoria section, Ameyugo-Manzanos subsection, and the Burgos-Miranda de Ebro Connection, affecting the municipalities of Lantarón and Ribera Baja.

Background of the file

On March 31, 2026, the president of the public business entity ADIF-Alta Velocidad resolved to provisionally approve the platform construction project and ordered the initiation of the public information file regarding the need for occupation, in accordance with Law 39/2015, of October 1, on the Common Administrative Procedure, and articles 18 and 19.1 of the Compulsory Expropriation Law, of December 16, 1954, and its regulation (decree of April 26, 1957).

The list of affected assets and rights was initially published in the BOE number 125, dated May 22, 2026. In that notice, the publication of a series of properties was omitted, which is why this correction of errors publication is now being carried out with the newly affected properties.

Affected properties and deadlines

The notice details the specific and individualized list of affected assets and rights, including the cadastral reference, current owner, expropriation area, easement, temporary occupation, and total occupation. In the municipality of Lantarón, three properties are included, and in Ribera Baja, twelve, including large-area plots:

  • Lantarón: properties M-01.9020-0107, M-01.9020-0118, and M-01.9020-0119, with owners such as M. Pilar Saez López, Inés Olga Saez López, Eusebio López Carro, Mª Ángeles Pérez Martínez de Marigorta, and José Pinedo Moraza.
  • Ribera Baja: properties M-01.0474-0100 to M-01.0474-0489, with owners such as Ángela Anguiano Cuellar, Joseba and Rubén Ocio Trincado, Jesús Barredo Arana, José Luis Ortíz Ruiz, the Ibañez Araico family, Dionisio Barredo Arana, the Unamunzaga Guinea family, Miguel Ángel Turismo Montoya, and the Provincial Council of Álava.

A public information period of fifteen business days is opened, starting from the day following the publication of the notice, so that any person may provide in writing data to rectify possible errors in the list or oppose, for reasons of substance or form, the need for occupation.

The expropriation documentation may be examined, during business days and office hours, at several locations:

  • Government Sub-delegation in Álava (calle Olaguibel 1, 01071 Vitoria-Gasteiz).
  • Infrastructure Projects Directorate of ADIF-Alta Velocidad (calle Titán 4 and 6, 1st floor, 28045 Madrid).
  • Lantarón City Council (Ayuntamiento Kalea 2, 01213 Comunión).
  • Ribera Baja City Council (San Martín Plaza 1, 01213 Ribabellosa).
  • Transparency portal of the ADIF-Alta Velocidad website (www.adifaltavelocidad.es).

Allegations shall be addressed to the Infrastructure Projects Directorate of ADIF-Alta Velocidad, indicating as a reference “Public information of the declaration of the need for occupation. Construction Project of the Platform of the High-Speed Line for the Madrid-Basque Country-French Border Connection. Section: Burgos-Vitoria. Subsection: Ameyugo-Manzanos and Burgos-Miranda de Ebro Connection”. The General Electronic Registry of the General State Administration (https://rec.redsara.es) and the Electronic Office of ADIF-Alta Velocidad (https://sede.adifaltavelocidad.gob.es) may also be used.

The announcement was signed in Madrid on August 17, 2026, by the general director of ADIF-Alta Velocidad, Luis Llamas Martínez.

The publication serves as a guarantee for the owners of Lantarón and Ribera Baja, who see their right restored to know and appeal the impact on their properties by the AVE route before the need for occupation is declared, an essential preliminary step for the future expropriation of the land.
