Adif expropriates land in Noreña for the new cross-platform connection

The Ministry of Transport and Sustainable Mobility has opened the public information period for the compulsory expropriation file 432ADIF2698, motivated by the works of the construction project for a new grade-separated crossing between platforms and the improvement of accessibility at the Noreña station (Asturias). The resolution was signed by the Director General of the Railway Sector on October 15, 2026, and published in the Official Gazette of the Principality of Asturias (BOPA) no. 206, dated October 23, 2026, under code 2026-08608. The owners of the affected assets and rights have 15 business days to submit allegations.

The Railway Infrastructure Administrator (Adif) requested the initiation of the file on June 23, 2026, to obtain the land necessary to execute the works. The reference project was approved on October 31, 2025, and this approval entails the declaration of public utility or social interest, the need for occupation of the affected assets, and the declaration of urgency for the occupation, in accordance with Law 38/2015, of September 29, on the Railway Sector.

Due to this urgent nature, the provisions of Article 52 of the Compulsory Expropriation Law of December 16, 1954, and the corresponding sections of its Regulation of April 26, 1957, are applicable, which allows for the drawing up of records prior to occupation without waiting for the final resolution of the fair price.

Fifteen business days to submit allegations

The Directorate General of the Railway Sector has resolved to open public information for a period of 15 (fifteen) business days, counted in the manner provided for in Article 17 of the Regulation of April 26, 1957. Both the owners of the affected assets and rights, as well as any other interested person or entity, may submit written allegations to that department, in accordance with the Compulsory Expropriation Law and Article 56 of its implementing Regulation.

The publication in the BOPA also serves as notification for unknown interested parties or those with an unknown address, for the purposes provided for in Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. In any case, those summoned will be individually notified of the act of drawing up the preliminary records.

Seven affected properties in the municipality of Noreña

The expropriation annex of file 432ADIF2698 identifies seven properties in the municipality of Noreña, indicating the polygon or cadastral reference, plot, owner, address, areas for expropriation, easement and temporary occupation, and the nature of the asset:

• X-33.0426-0001, on Av. de Gijón, urban in nature, owned by the Noreña City Council (Av. Flórez Estrada 2, 33180 Noreña).
• X-33.0426-0002, rural in nature, owner unknown.
• X-33.0426-0003, rural in nature, in the name of the Regional Ministry of Development, Local Cooperation and Fire Prevention of the Principality of Asturias (C/ Antonio Suárez Gutiérrez 2, 33005 Oviedo).
• X-33.0426-0004, rural in nature, owner unknown.
• X-33.0426-0005, rural in nature, belonging to María Concepción Mencía Triguero (Lg El Morralín 21, 33180 Noreña).
• X-33.0426-0006, rural in nature, in the name of the heirs of Ana María Menéndez Hevia (Gijón).
• X-33.0426-0007, on Av. Langreo, urban in nature, owned by the Noreña City Council.

Consultation of the file and call for preliminary records

The expropriation annex may be consulted at the headquarters of the Ministry of Transport and Sustainable Mobility (paseo de la Castellana, 67, 28046 Madrid), at the Sub-directorate of Expropriations of Adif-Alta Velocidad (avda. Pío XII, 110, Caracola n.º 18, 28036 Madrid), at the respective city councils, and at the affected government sub-delegations or delegations. It is also available in the Public Participation section of the ministry’s website (www.transportes.gob.es) and in the public information section of the Adif transparency portal (www.adif.es).

The resolution summons the owners to the drawing up of the records prior to occupation at the location designated by the Noreña City Council. The act is scheduled for December 1, 2026, at 10:00 AM, for properties X-33.0426-0002, X-33.0426-0004, X-33.0426-0005, and X-33.0426-0006.

The opening of this procedure directly affects the owners in the municipality, who face the loss or limitation of use of their land within a tight schedule: first the period for filing objections and then the appearance before the expropriating body. The declared urgency implies that occupation may take place before the price is fixed; therefore, reviewing the annex and submitting objections within the deadline are the available means to dispute the affected area or ownership.
