A Xunta aproba as expropiacións da mellora peonil na AC-840 en Oza-Cesuras

The Galician Infrastructure Agency has approved the public information file and, definitively, the expropriation annex for the pedestrian mobility improvement works on the AC-840 road, in the municipality of Oza-Cesuras (A Coruña). The resolution, issued on August 26, 2026, by the director of the agency by delegation of the Minister of Housing and Infrastructure Planning, was made public in the Official Gazette of Galicia (DOG) no. 198, of October 19, 2026, in section VI. Announcements, under the reference CVE-DOG: 6ske1dl4-hjw5-fi52-ft84-y7pxiipsz9e9. The agreement affects the owners of the plots that must be occupied to maintain the width of the service road.

Origin of the file and change of layout

The construction project for the action, code AC/22/111.06, had been approved by resolution of the Galician Infrastructure Agency on November 21, 2023. Once the works began, it was detected that, although both the path and the underpass beneath the railway tracks are located entirely on a plot belonging to the public railway domain, it was necessary to occupy part of other plots to maintain the width of the service road. This necessity led to a modification of the layout and required the processing of an expropriation annex.

The provisional approval of the document for public information occurred via a resolution from the director of the agency on June 23, 2026. The text was submitted for exhibition in the municipality of Oza-Cesuras, in the province of A Coruña.

Fifteen business days and no objections

The annex and the individual list of affected assets, rights, and owners were published in DOG no. 127, of July 9, 2026, through an announcement on June 25, 2026. The process was opened for a period of 15 business days starting from the day following publication, for the purposes provided for in the Law of December 16, 1954, on compulsory expropriation and the Decree of April 26, 1957.

According to the resolution, no objections were received during the public information period. On August 19, 2026, the project management, with the approval of the Infrastructure Design Area, issued a report and a resolution proposal favorable to the definitive approval.

What the resolution approves

The agreement published in the DOG contains two pronouncements:

  • To approve the public information file of the expropriation annex for the pedestrian mobility improvement on the AC-840 in Oza-Cesuras, code AC/22/111.06.
  • To approve the content of the document without modifications regarding the list of affected assets and rights that had been collected in the text submitted for public information.

The competence to resolve public information proceedings regarding roads corresponds to the Minister of Housing and Infrastructure Planning according to Decree 118/2022, of June 23, and is delegated to the head of the Galician Infrastructure Agency by article 8.1.b) of the Order of September 7, 2017. The resolution bears the signature of Carlos Lefler Gullón, head of the Infrastructure Design Area.

Deadlines for appeal

The resolution ends the administrative route. Interested parties have:

  • Two months to file a contentious-administrative appeal before the Contentious-Administrative Chamber of the High Court of Justice of Galicia, counted from the day following the publication in the DOG.
  • One month, as a prior and optional measure, to file a request for reversal (recurso de reposición) before the Minister of Housing and Infrastructure Planning.
  • Form IF321B, for subjects obliged to interact electronically with the Administration, available on the electronic headquarters of the Xunta de Galicia.

The final approval of the annex closes the administrative phase prior to the occupation of the plots and opens the way for the Galician Infrastructure Agency to proceed with the execution of a work that directly affects the owners of the lands located in the surroundings of the AC-840 road as it passes through Oza-Cesuras. For these neighbors, the announcement now establishes the deadlines for claiming and the framework in which the compensations for the occupied assets and rights will be determined.
