A Xunta aproba a senda na PO-313 en Moaña por 3,1 millóns

The Council of the Xunta de Galicia has definitively approved the layout project for a path on the PO-313 road, in the municipality of Moaña, with a base tender budget, VAT included, of 3,137,238.95 euros. The decision, adopted at the meeting on September 28, 2026, is made public in the Official Gazette of Galicia (DOG) no. 193, of October 9, 2026, through the Resolution of September 29, 2026 of the Galician Infrastructure Agency. The action is eligible for co-financing by the European Union through the European Regional Development Fund (ERDF), within the framework of the Galicia ERDF 2021-2027 program.

The resolution, signed by the director of the Galician Infrastructure Agency, María Deza Martínez, orders the publication of the Council of the Xunta agreement and includes the full text of the approval as an annex. The project corresponds to key PO/24/126.06 and is processed under article 55.6 of Decree 66/2016, of May 26, which approves the General Road Regulations of Galicia.

The immediate background of the file is the public information process. On February 13, 2026, the Announcement of February 10, 2026, was published in DOG no. 30, which submitted the layout project and the individual list of affected assets, rights, and owners to public exhibition. Now, the agreement approves the file corresponding to the public information procedures and the report from the affected administrations, along with the definitive approval of the layout.

Definitive approval and budget

The agreement approves the file of the public information procedures and the report from the affected administrations and, definitively, the layout project of the path on the PO-313 in Moaña. The base tender budget, VAT included, is set at 3,137,238.95 euros, an amount that coincides with that allocated in the published resolution.

The action is part of the promotion of sustainable mobility and has potential European funding through the ERDF, within the Galicia ERDF 2021-2027 program, as stated in the agreement itself.

Modifications to reduce the impact on plots

Regarding the layout submitted for public information, the agreement introduces changes aimed at minimizing the impact on assets, walls, gates, and homes:

  • The expropriation line is decreased by 1 meter in the plots with cadastral references 36029A01900029, 36029A02000121, 36029A01700014, 36029A01700015, 36029A02000119, 36029A02000120, 36029A01700033, and 3866019NG9836N, to avoid the expropriation of several walls and gates.
  • The width of the path is reduced as it passes in front of plot 36029A01700020, in order not to affect the foundation of the house; in the eastern part of the same plot, the expropriation line is also decreased by 1 meter.
  • In plot 36029A02006007, the northern fence will not be affected and, in the southern area, at the boundary with the adjacent plot, a wall perpendicular to the road will be constructed.

Expropriations, urban planning, and appeals

Definitive approval implies a declaration of public utility, the need for the occupation of assets and the acquisition of the necessary rights to execute the works, as well as the urgency of the occupation, in accordance with article 22.5 of Law 8/2013, of June 28, on Galician roads.

The Moaña City Council must adapt its urban planning to the content of the project within one year and, in any case, in its first modification or revision, according to article 23.1 of the same law.

Against the agreement, which ends the administrative route, the following are applicable:

  • Contentious-administrative appeal before the High Court of Justice of Galicia within two months counting from the day following the publication in the DOG.
  • Appeal for reversal, on an optional and prior basis, within one month, using form IF321B before the counselor of Housing and Infrastructure Planning.

Definitive approval unlocks the bidding and execution of an infrastructure that directly affects the residents of Moaña, both through the improvement of pedestrian mobility on the PO-313 and through the opening of the expropriation phase and the municipal obligation to adjust urban planning to the new layout.
