The Xunta approves the path of the PO-303 between Tarrío and Arén

The Council of the Xunta has definitively approved the layout project for the promotion of sustainable mobility on road PO-303, in the section between Tarrío and Arén, with a base tender budget, VAT included, of 1,263,700.53 euros. The decision, adopted in the session of October 13, 2026, is made public in the Official Gazette of Galicia (DOG) no. 201, of Thursday, October 22, 2026, through the Resolution of October 15, 2026 of the Galician Infrastructure Agency. The agreement ends the administrative route and enables the occupation of the land necessary to execute the work.

The resolution, signed by the director of the Agency, María Deza Martínez, orders the publication of the agreement of the Council of the Xunta and its annex, which details both the modifications introduced to the layout and the definitive approval of the project, identified with the key PO/24/129.06. The file was processed by virtue of the provisions of article 55.6 of Decree 66/2016, of May 26, which approves the General Road Regulations of Galicia.

The project arrives only after a previous administrative process. The announcement of March 17, 2026, published in DOG no. 55 of March 24, submitted the layout project and the individual list of affected assets, rights, and owners to public information. That procedure allowed for changes to be incorporated into the initial design, which are now collected in the agreement approved by the Galician Government together with the report from the affected administrations.

Modifications introduced after public information

The definitive layout introduces four adjustments compared to the version submitted for public exhibition, all of them aimed at reducing the impact on existing properties and accesses:

• In plot no. 31 (cadastral reference 1066726NG2916N) and in plot no. 32 (cadastral reference 1066725NG2916N), the entrances to the existing gradients and access conditions will be restored and adapted, along with the restoration of the recessed fence of plot 32 and the meter recesses.
• In plot no. 13 (cadastral reference 1266803NG2916N), the planned occupation is adjusted, limiting it to the land between the public domain line of the road and the current fence of the property; thus, the fence is maintained and its demolition and replacement are ruled out.
• In plot no. 57 (cadastral reference 0766009NG2905N), the existing pedestrian gate is preserved and the connection between this access and the new path will be adapted, in addition to restoring the boundary wall and the meter recesses.

Expropriations and adaptation of urban planning

The final approval of the project entails, according to article 22.5 of Law 8/2013, of June 28, on Galician roads, the declaration of public utility and the need for the occupation of assets and the acquisition of the rights necessary to execute the works. The regulation extends this declaration to deposits of surplus materials, the loans necessary for execution, and the restoration of affected services, and establishes the urgency of occupation for the purposes of expropriation, temporary occupation, or the imposition of easements.

The agreement also has consequences for municipal planning. Pursuant to article 23.1 of the same law, the Poio City Council, where the infrastructures subject to the project are located, must adapt its urban planning to the content of the project within one year and, in any case, in its first modification or revision.

Two deadlines to appeal

The agreement of the Council of the Xunta, which exhausts the administrative route, opens two possibilities for challenge:

• Contentious-administrative appeal before the High Court of Justice of Galicia within a period of two months counted from the day following the publication of the resolution in the DOG, in accordance with articles 8, 14, and 46.1 of Law 29/1998, of July 13.
• Optional appeal for reversal within a period of one month, also from the day following publication, before the Minister of Housing and Infrastructure Planning, in accordance with articles 123 and 124 of Law 39/2015, of October 1. Subjects obliged to interact electronically must use form IF321B, available on the electronic headquarters of the Xunta de Galicia.

The path between Tarrío and Arén is part of the regional commitment to enable safe pedestrian and cyclist itineraries in road surroundings, a type of action that directly impacts the daily mobility of residents and the safety of non-motorized travel. With the final approval of the layout and the fixing of the tender budget, the work is ready to be contracted, although the effective calendar will depend on the tender and the execution of expropriations on the affected properties.
