Por FactBox Admin

The General Sub-directorate of Transport Inspection has notified via edicts two sanctioning resolutions for infringement of land transport regulations to a carrier who could not be located. The imposed fines total 5,002 euros and are published in the Official Gazette of Galicia (DOG) number 190, dated October 6, 2026, in section VI of announcements.
The notification is carried out under article 44 of Law 39/2015, of October 1, on the common administrative procedure of public administrations, which allows for publication by edicts when postal notification proves unsuccessful. The resolutions were issued by the General Director of Mobility in sanctioning files PO-00551-O-2025 and PO-00552-O-2025, processed by the Ministry of Presidency, Justice and Sports. The announcement is dated September 21, 2026, and is signed by Laura González-Dopeso Portela, General Sub-director of Transport Inspection.
The effectiveness of the notification is subject to its publication on the single edicts board of the Official State Gazette (BOE).
Two sanctions for the same owner and vehicle
The annex of the announcement details two infractions committed by the same owner, with DNI 09362675L, and the same vehicle, license plate 5509-DFL, detected during the same inspection:
- File PO-00551-O-2025: carrying out transport under private complementary service transport authorizations that do not comply with one of the conditions of article 102.2 of the LOTT. Qualifying precepts: article 140.1 of the LOTT and article 197.1 of the ROTT; sanctioning precepts: article 201.i) of the ROTT and article 143.1 of the LOTT. Sanction imposed: 4,001 euros.
- File PO-00552-O-2025: use of the tachograph without performing its calibration or periodic review within the established deadlines and manner. Qualifying precepts: article 140.34 of the LOTT and article 197.39 of the ROTT; sanctioning precept: article 143.1.g) of the LOTT. Sanction imposed: 1,001 euros.
Both infractions were recorded on January 13, 2025, at 21:07 hours, at kilometer point 303.0 of the A-52 highway.
One-month deadline to appeal
Against the sanctioning resolution, which is not final in the administrative route, an appeal for reversal (recurso de alzada) may be filed before the head of the Ministry of Presidency, Justice and Sports within one month starting from the day following the publication of the announcement in the BOE.
In case of agreement, the interested party must pay the imposed fine using the printed form that will be provided at the General Sub-directorate of Transport Inspection. If no appeal is filed and payment is not made, collection will proceed via the enforcement route according to current regulations.
Consultation of the file
The full text of the resolution and the rest of the case documentation are available to interested parties at the Subdirección Xeral de Inspección do Transporte (General Sub-directorate of Transport Inspection), located at Praza de Europa, 5A, 2nd floor (Área Central building), 15707 Santiago de Compostela (A Coruña), from 9:00 AM to 2:00 PM.
Publication by edict ensures that the resolution reaches the interested party when personal notification fails, and opens the period for appeal or payment. For transporters, the announcement reminds them that complementary private transport authorizations and up-to-date tachographs are obligations enforceable at any roadside check.
