A Gudiña delegates the mayoralty to the deputy mayor due to absence

The Concello da Gudiña (Gudiña City Council) has publicized the delegation of all Mayoral functions to the first deputy mayor, Gilberto Sánchez Prieto, during the absence of the municipal mayor. The measure, adopted through Mayoral Decree 2026/0162, dated August 28, covers the period between September 2 and September 20, 2026, both dates inclusive, and was published in the Official Gazette of the Province of Ourense on September 14.

The delegation aims to ensure the continuity of municipal management during the absence of the mayor, Néstor Ogando Blanco, who signed the decree on September 1, 2026. The measure falls within the framework of local regime regulations governing the temporary substitution of municipal bodies.

Legal framework of the delegation

The decision is based on Article 23.3 of Law 7/1985, of April 2, regulating the bases of the local regime, as well as Articles 47 and 44 of Royal Decree 2568/1986, of November 28, which approves the Regulation on the organization, operation, and legal regime of local entities. These provisions enable the delegation of Mayoral powers to deputy mayors in cases of absence or impossibility.

Content of the decree

The operative part of the decree establishes the following points:

• Delegate the exercise of all Mayoral functions to deputy mayor Gilberto Sánchez Prieto from September 2 to September 20, 2026, both dates inclusive.
• Inform the Plenary during the next session to take place.
• Publish the delegation in the Official Gazette of Ourense.
• Notify the agreement to the interested party, stating that the decree will be effective from the day following its signature and that it is understood to be tacitly accepted if no express manifestation to the contrary is made within three business days from the notification.

Processing and effects

The decree was signed by mayor Néstor Ogando Blanco on September 1, 2026, and registered under number R. 2.111. The delegation will enter into force the day after its signature, thus guaranteeing the operability of the local government throughout the period of absence.
