The Deputación de Ourense will collect traffic fines from Viana do Bolo
Por FactBox Admin

The Plenary of the Provincial Council of Ourense unanimously accepted the delegation from the City Council of Viana do Bolo to exercise the powers of collection, in both voluntary and executive periods, of debts corresponding to traffic violation fines. The agreement was adopted in the ordinary session of July 23, 2026, and published in the Official Gazette of the Province of Ourense on October 20, 2026, in section I. Provincial Council of Ourense, with reference R. 2.343 and the signature of the provincial president, Luis Menor Pérez.
The delegation had been previously approved by the City Council of Viana do Bolo through a plenary agreement on May 22, 2026, and is now ratified by the provincial institution. The legal framework invoked is Article 7 of Legislative Royal Decree 2/2004, of March 5, which approves the revised text of the Law regulating local treasuries, together with Article 106.3 of Law 7/1985, of April 2, regulating the bases of the local regime.
All powers, from the seizure order to appeals
The content of the delegation covers the exercise of all powers necessary to carry out collection in both voluntary and executive ways. This includes issuing all administrative acts required for the management of the procedures, including:
- The issuance of the seizure order (providencia de constrinximento).
- The resolution of administrative appeals filed against executive collection acts.
The jurisdictional boundary is fixed at the sanctioning procedure: the initiation, instruction, and resolution correspond to the administrative bodies of the City Council of Viana do Bolo that have those competencies assigned within the council. The Provincial Council, therefore, acts in the collection phase, although it collaborates in the processing.
5% fee for voluntary and 100% of the surcharge for executive
The agreement details the cost of the service for the municipal coffers. The fee to be paid by the City Council of Viana do Bolo results from applying a single tax rate of 5% to the amounts effectively collected when payment occurs during the voluntary period. In the case of executive collection, the fee is equivalent to 100% of the surcharge corresponding to each case.
Both formulas refer to Article 6, sections a) and b), of the Fiscal Ordinance regulating the provision of management, inspection, and collection services of the Provincial Council of Ourense. The provincial institution will deduct the amount corresponding to the settled fee from the transfer of the collected amount, without prejudice to notifying that settlement in the manner provided for in Article 9 of the same ordinance.
To be able to initiate executive collection, the City Council must send the certifications of the list of debtors from the last four years. In the case of debts prior to that period, it must certify that they have not prescribed and indicate the various dates of notification of the debt in executive collection.
Four years of extendable validity
The delegation will enter into force once accepted by the Provincial Council and must be published in the Official Provincial Gazette and in the Official Gazette of Galicia for general knowledge. The validity is established for a period of four years, tacitly extendable for equal periods of four years.
To avoid automatic extension, either of the two parties must expressly communicate their contrary will to the other with a notice of no less than six months regarding the end of the current period or any of its extensions.
The publication coincides in the same issue of the gazette with the acceptance of another similar delegation, in this case from the City Council of Sarreaus, for the management, settlement, and collection of the domestic water supply fee and the water canon, agreed upon by the provincial Plenary on September 25, 2026, and referenced as R. 2.344.
The decision transfers to the provincial body the collection management of a matter with high litigation and a large volume of files in small municipalities, such as road discipline. For the residents of Viana do Bolo, it means that files for fines not paid within the deadline will be processed using the Provincial Council’s executive collection tools, including account freezes and seizures, while the power to sanction remains in municipal hands.
