The Miño-Sil Confederation expropriates assets for the Val de Lemos canal

The Miño-Sil Hydrographic Confederation, O.A. calls for the drawing up of the records prior to occupation and the records of occupation of the assets and rights affected by the compulsory expropriation necessary to execute the improvement and conditioning works of the service road of the right bank canal of the Val de Lemos irrigation system, in the municipality of Monforte de Lemos. The call is published in the Official Gazette of the Province of Lugo no. 226, of October 2, 2026, with reference R. 2599, and the appearances are scheduled for November 24 and 25, 2026.

The announcement is signed by the president of the organization, José Antonio Quiroga Díaz, in Ourense on September 23, 2026, and is processed under the key M1.253-035/2111. The project is officially named «Proyecto de obras de mejora y acondicionamiento de la carretera de servicio del canal de la margen derecha del regadío del Valle de Lemos (Lugo). PDM Miño-Sil. ES010_3_CHCH0CCET29SP2472. PCPE-07».

Urgency declared by the Council of Ministers

The expropriation action is based on a chain of administrative decisions already published. By resolution of the Miño-Sil Hydrographic Confederation, O.A. of February 13, 2026, it was agreed to submit the project for public information, together with the list of assets and rights requiring occupation, in application of article 18 of the Compulsory Expropriation Law of December 16, 1954, and article 17 of its Regulations.

For the execution of the works, the urgent occupation of the affected assets and rights was declared by agreement of the Council of Ministers on August 25, 2026. This declaration implies the application of the regime of article 52 of the current Compulsory Expropriation Law and the corresponding provisions of the Regulations of April 26, 1957, which allows the organization to summon the owners directly without the prior procedure of mutual agreement.

Dates, place and times of the summons

The appearances for the drawing up of the records will take place at the office of the Miño-Sil Hydrographic Confederation, O.A. in Monforte de Lemos, according to this schedule:

• Place: Calle La Pinguela, s/n, 27400 Monforte de Lemos (Lugo).
• November 24, 2026, from 10:00 to 14:00 hours.
• November 25, 2026, from 10:00 to 14:00 hours.

The call is notified to the owners through individual notices and through announcements in the newspapers «El Progreso» and «La Voz de Galicia», in the Official State Gazette and in the Official Gazette of the Province of Lugo. The list of affected assets and rights was published in the Official State Gazette of February 19, 2026, in the Official Gazette of the Province of Lugo of February 21, 2026, and in «La Voz de Galicia» of February 21, 2026, and could be consulted with the parcel maps at the organization’s office in Monforte de Lemos and at the Monforte de Lemos City Council.

Allegations and documentation required from those affected

Interested parties must appear in person or be represented by a proxy, provided with their National Identity Document, the bank book of the holders, and a photocopy of the documentation proving ownership. They may be accompanied by their experts and a notary, the cost of which shall be borne by them.

Pursuant to article 56.2 of the Compulsory Expropriation Regulations, until the moment the preliminary minutes are drawn up, interested parties may submit written allegations to the Miño-Sil Hydrographic Confederation, O.A., at rúa Curros Enríquez no. 4, 2nd floor, 32003 Ourense, for the sole purpose of correcting possible errors in the list of assets affected by the urgent occupation.

The publication of the call also serves the purposes of article 44 of Law 39/2015, of October 1, when the owners of the properties are unknown, the place of notification is unknown, or notification cannot be carried out.

The call opens the effective expropriation phase of an irrigation infrastructure affecting owners of plots in Monforte de Lemos, who now know the specific dates to appear and claim regarding the valuation and ownership of their lands.
