A Comisión Bilateral Estado-Galicia abre negociacións sobre o traspaso da AP-9

The Bilateral Cooperation Commission of the General State Administration-Autonomous Community of Galicia has agreed to initiate negotiations to resolve the discrepancies expressed in relation to Organic Law 3/2026, of July 29, on the transfer of ownership and competencies of the Atlantic Highway (AP-9) to the Autonomous Community of Galicia. The agreement, adopted on September 3, 2026, is ordered to be published in the Official Gazette of Galicia (DOG) no. 189, of October 5, 2026, on page 51291, section III (Other provisions), by resolution of the General Directorate of Institutional and Parliamentary Relations of the Department of Presidency, Justice and Sports.

The publication is carried out pursuant to article 33 of Organic Law 2/1979, of October 3, of the Constitutional Court, amended by Organic Law 1/2000, of January 7. The resolution is dated September 17, 2026, and is signed by the Director General of Institutional and Parliamentary Relations, Sandra Vázquez Domínguez. The full text of the agreement appears as an annex to the resolution, with the official reference CVE-DOG: yfwjho23-csc9-wwv1-llf1-twixm9rbqx65.

What the Bilateral Commission agrees

The agreement consists of three points:

  • To initiate negotiations to resolve the discrepancies expressed in relation to Organic Law 3/2026, of July 29, on the transfer of ownership and competencies of the Atlantic Highway to the Autonomous Community of Galicia.
  • To designate a working group to propose the appropriate solution to the Bilateral Cooperation Commission.
  • To communicate the agreement to the Constitutional Court for the purposes provided for in article 33.2 of Organic Law 2/1979, as well as to insert it in the Official State Gazette and the Official Gazette of Galicia.

Who signs the agreement

The agreement is signed by the two representatives of the Bilateral Commission:

  • Ángel Víctor Torres Pérez, Minister of Territorial Policy and Democratic Memory.
  • Diego Calvo Pouso, Councilor of Presidency, Justice and Sports.

The regulation subject to the discrepancy is Organic Law 3/2026, of July 29, on the transfer of ownership and competencies of the Atlantic Highway (AP-9) to the Autonomous Community of Galicia.

Background of the bilateral mechanism

This is not the first time that the Bilateral Commission has resorted to this procedure. DOG no. 177, of September 17, 2026, p. 49070, published an agreement of July 23, 2026, by which both parties considered the discrepancies regarding the Law of the Autonomous Community of Galicia 3/2025, of December 15, amending Law 3/2012, of April 2, on sports in Galicia, to be resolved.

In that case, the previously constituted working group allowed the controversy to be resolved through an agreed interpretation of the precept, with the same communication to the Constitutional Court and the same insertion in the Official State Gazette and the Official Gazette of Galicia.

The opening of this negotiation implies that the resolution of discrepancies regarding the transfer of the AP-9 remains in the hands of the working group, which must propose a solution to the Bilateral Commission. The agreement will be communicated to the Constitutional Court and will also be published in the Official State Gazette, such that the outcome of the procedure will condition the effective transfer of ownership and competencies of the highway to the Autonomous Community.
